The case of Lindsey Clancy,
the Massachusetts mom accused of killing her three young kids,
may get a retrial.
Prosecutors and the defense made their arguments to the judge today.
Fox News' Lauren Green has more.
Lindsey Clancy back in a Massachusetts courtroom Monday
as prosecutors grappled with the next steps in trying her case again.
What we had here was a very lengthy trial.
Many witnesses, in the circumstances of this case,
there existed manifest necessity for mistrial.
The Massachusetts mother was charged with killing her three children,
but her defense team says she was suffering
from a condition known as postpartum psychosis.
Clancy has been held at a state-run psychiatric hospital since
her first trial ended with a hung jury.
Eleven jurors appeared sympathetic to her insanity defense.
While one pushed for a conviction.
There was a potential here, a viable alternative,
which is a probing for a deal, could have disclosed
that the juror wasn't following the instructions.
Whether a new trial would be another murder trial
remains to be seen.
Prosecutors are seeking a gag order that would limit
what can be said to the media about the case.
We're not at that point yet.
I think once we get the decisions on the motions
and see what happens from there,
then we would decide what that looks like.
Clancy's defense attorneys want the judge to dismiss the case outright.
But if a retrial does happen, they're asking for a speedy timeline.
I am not going to have this woman sit incarcerated
for the next year or two or three.
I want a trial, and I want it with you, and I want it this spring.
The judge floated March as a possible trial date.
Clancy will be back in court in two weeks.
