Prosecutors say they are moving forward
with plans to retry Lindsay Clancy.
The Duxbury mother is accused of killing her three children.
Her first trial gained international attention.
It ended in a mistrial.
Thanks for joining us, everybody.
I'm Carrie Kavanaugh.
Boston 25 News reporter Bob Ward was in court today as the prosecutor
and the defense exchanged some heated blows.
Before we get to any retrial of Lindsay Clancy,
there are still some important legal issues that have to be worked out.
Defense wants all the charges thrown out.
The D.A. wants a gag order on all the attorneys in this case.
So here at Superior Court in Plymouth, things got a little heated.
Wait a minute, Mr. Clancy.
Lindsey Clancy, back in a Plymouth County Superior Court
that was packed with attorneys, media, and onlookers
for a motions hearing designed to move her case closer to resolution.
Clancy is facing charges for the strangulation deaths
of her three young children in the basement of her Duxbury home.
Her lawyers claim she was not criminally responsible,
that she was in the grip of postpartum psychosis after months
of failing to get proper mental health treatment.
Clancy's trial deadlocked when one single juror voted to convict her.
The DA has yet to determine if the state will retry Clancy for murder.
At this hearing, Clancy's defense team argued that the charges against
her should be dropped on double jeopardy grounds,
saying the judge should have questioned the holdout juror more
thoroughly and possibly replaced him for not deliberating.
Defense attorney Kevin Reddington tangled with Judge William Sullivan
when he said the juror's name in court.
I'm going to stop you right now.
No, you're not going to stop me.
Well, no, I am.
No, you're not.
Because, all right, then this hearing's, you know,
because there's no need to bring out that juror's name.
It's all over the internet.
You know what? That's through the internet.
But it didn't end there.
After court, the holdout juror's lawyer accused Reddington
of ruining his client's life.
In court today, you saw an absolutely unhinged man, a very sad man.
Prosecutors are seeking a gag order on all the attorneys in the case.
For his part, Kevin Reddington did
not fire back at the holdout juror's attorney.
He called you unhinged in court.
Good for him. That's good.
He's coining a phrase from his lawyer from Houston.
As for Lindsey Clancy's legal future,
the D.A. says he still has not decided his next move,
but a decision could be close.
Do you think you'll have a decision in two weeks?
That's my plan.
Both sides are due back here in court on November 16th,
and depending on how the judge rules on these motions, we might get
a trial date, and the judge is thinking about sometime in March.
