Will Lindsay Clancy take the witness stand in her ex-husband’s wrongful death lawsuit against the mental health professionals who treated her before the deaths of their three children?
We're now just days away from learning whether or not Lindsey
Clancy will be retried for the murders of her three children.
Prosecutors appear ready to move forward with plans.
Lindsey Clancy will be back in court coming up on Monday.
Also happening now, attorneys for her ex-husband Patrick trying
to get his malpractice lawsuit to move forward.
Boston 25 News reporter Bob Ward live in the studio.
Bob, it appears unlikely Lindsey would have to testify in that case.
Well, Scott, Patrick Clancy's lawyer told
the court that Lindsey Clancy would take the stand
in his lawsuit against her mental health care professionals.
Now, that's a bold claim.
And Lindsey's lawyer is saying it's not going to happen.
Dr. W. Clancy et al. versus Jennifer A. Tuss, M.D. et al.
This court hearing is the first step
in Patrick Clancy's wrongful death lawsuit against
the mental health professionals who treated his wife, Lindsey Clancy.
Lindsay Clancy is accused of the strangulation deaths
of her three young children in their
Duxbury home in January 2023.
Lindsay's triple murder trial ended in a mistrial,
but Patrick Clancy's civil suit is now moving forward.
And at this hearing, Patrick's lawyer
argued that Lindsay herself will take the stand
to testify that she told mental health professionals
that she was having thoughts of harming her children.
We believe that Lindsay Clancy,
Once her Fifth Amendment issues are resolved, one way or the other,
We'll testify that she told
these defendants explicitly.
She had homicidal ideation that she
was worried about something awful happening to her kids.
But Lindsay's lawyer, Kevin Reddington,
almost immediately issued a statement saying that's not true
and that Lindsay is not taking the stand.
It reads, Lindsay Clancy never told any of her health care providers
that she harbored homicidal ideation toward her children.
She never indicated that she intended
to testify in Mr. Clancy's lawsuit.
And no one acting for her ever represented that she would.
If I'm the defense attorney in a criminal case, I'm saying no way.
There's no way you would let her take the stand?
Absolutely not.
Boston criminal defense attorney Elise
Hershon tells me Lindsey Clancy would have
too much to lose on the stand. According to her attorney,
Lindsey Clancy is still on suicide watch at Tewksbury State Hospital.
So where the criminal trial is still active,
she's still actively facing these
legal charges, these criminal charges of murder.
It is not a good idea. She has to think about herself,
her own protection and her own mental health. And both
of those things could be in jeopardy if she were to take the stand.
Now we expect we will see Lindsey Clancy, not on the stand,
but in a Plymouth County Superior courtroom on Monday.
We don't know yet if the DA will seek to try her again for murder.
There's a hearing scheduled and there are motions from both sides.
Still a lot to sort out.
I'm Bob Worf, your local station, Boston 25 News.
Yeah, certainly a lot to track and follow. Okay, Bob, thank you.
