Welcome back. The verdict watch for the Lindsay Clancy murder trial continues
today in Plymouth, Massachusetts. The jury is deadlocked, but we'll be back
for seventh day of deliberations. And Kaylee Skyler is there with the very
latest. What's going on now? Hi there, Jen and Sandra. So the judge heard
arguments this morning morning about the fourth note that the juror sent to
the judge yesterday afternoon. It indicated that there was a lone juror
that was not able to follow instructions about reasonable doubt.
The judge ultimately decided not to dismiss this juror. And this morning
he read additional instructions before sending them back to deliberations.
Here's the arguments in court. We have a person who under their oath stood
in front of you yesterday when you did the individual of Y idea. And
according to this information under oath looked you in the eye and lied.
The note indicates that the parties disagree on what is reasonable doubt or
what doubt is and how it should be applied. And we're in no position to
judge if the 11 are right or the one is right.
So we do not know which way the jury is split, but Reddington has been
suggesting it's in the defense's favor after the jury sent that note yesterday
afternoon and animated intense sidebar followed. And for the first time,
Reddington brought Clancy over to listen in. The judge then spoke to each
juror one by one before rereading instructions to them on reasonable
doubt. Now the prosecution has the burden to prove beyond a reasonable
doubt that Lindsay Clancy knew what she was doing was wrong when she killed
her Children and attempted suicide in 2023. The defense argues Clancy was
over medicated, suffering from postpartum psychosis and didn't have
control of her actions. So we're now on day seven of deliberations and this
jury of nine women and three men have now been deliberating for around 37
hours. And it's important to remember that the judge has issued that to a
Rodriguez charge, which was the final instructions for the jurors to try and
reach a verdict. So if at some point today they come back and still say
they're deadlocked, the judge could declare a mistrial. Jen and Sandra. And
then in that case, it would likely go back to trial separately and then you
would have to find a whole different pool of jurors, which by now, I mean,
this this story has gained such now international attention, national
attention that you're gonna you're gonna have a hard time finding a jury
pool that really doesn't know much about this case. Absolutely. And it
just makes you draw parallels to the Karen Reed case that was also here in
Massachusetts that blew up all over social media as well. In her first
trial, it was a hung jury. And then the second time around, a lot of people had
heard about that case. Ultimately, she was acquitted of the most serious
charges that first time. But this could play out a couple different ways
because if this case were to be retried, any decisions about it would be up to
the district attorney, District Attorney Tim Cruz. So he would have to
decide if he wants to retry this case. If he wants to maybe try to work out a
plea deal, we'll have to see what happens. And just to be clear, Kayleigh,
the sticking point here is that one soldier is a holdout. And the issue is
that this juror doesn't understand what a reasonable doubt is. Is that is that
what's going on?
Yeah. So that note that was sent yesterday, it was never read out loud
in court. But we got comments from Kevin Reddington saying that the four
person for the jury basically called out this single person. And then after
some sidebars again, they were very tense. The judge ultimately decided to
read instructions about reasonable doubt. And so that was yesterday
afternoon. And then this morning he heard those additional arguments just
about what to do with this juror because it is towing a very fine line
here. It's very rare for a jury for a juror to be able thrown out of a trial.
So it's been a very interesting morning and I think we're all on our toes out
here. Okay, so they go back to the deliberating room and we'll have to see
if they come to some sort of decision today or if it carries into yet
another week of this.
