The matter was purportedly prolonged by demands for an immediate dismissal.
Gabriel Hostin apparently won’t have to show up for his September 15 court date because the case is, or soon will be, dismissed.
On June 16, Westchester County, New York, cops issued a trespass citation to Hostin, 24, the son of The View co-host Sunny Hostin, for allegedly jogging alongside active train tracks.
Officers cited Gabriel Hostin under New York Penal Code Section 140.05 and released him at the scene.
In an update on the pending case, Hollywood gossip site TMZ quipped that the younger Hostin “puts trespassing case in rear-‘view'” by completing a diversion initiative known as Fresh Start on August 20.
The Westchester County government described Fresh Start in a November 2021 press release by explaining, in part, that those who qualify have “an opportunity to avoid prosecution and the potential for a criminal record.”
The very liberal Sunny Hostin is well known for insisting on The View – an ABC network talk show that appears to be televised group-therapy session for studio panelists afflicted with Trump derangement syndrome — that no one is above the law.
The Hostin camp was allegedly resistant, however, to settling the matter through the diversion program.
The New York Post implied that Sunny Hostin was responsible for delaying the resolution of the ticket through that program because she “consistently hammered away at the Westchester County District Attorney’s Office to make it all go away without any recourse.”
The Post also claimed that Sunny Hostin was supposedly engaged in a “two-month-long campaign to make the case disappear.”
A detailed article published by the Talk of the Sound news website seemed to concur:
“Sunny Hostin’s effort to get a trespassing charge against her son dismissed outright prolonged the case for weeks after Westchester County prosecutors repeatedly offered him a diversion program that ultimately led to the dismissal now being sought from the court, according to a new account provided directly to Talk of the Sound by the Westchester County District Attorney’s Office…
“Anna Young, director of communications and public affairs for Westchester County District Attorney Susan Cacace, told Talk of the Sound that prosecutors repeatedly offered Gabriel Hostin participation in Fresh Start, the office’s pre-arraignment diversion program for eligible first-time, low-level offenders.”
“‘The defendant’s attorney at the time declined our Fresh Start offer, instead insisting that the case be resolved with an immediate dismissal, a position that resulted in multiple court adjournments by the defendant,’ Young said.
“The District Attorney’s Office kept the offer open.
“‘Our office continued to make Fresh Start available, which the defendant’s new attorney, Teny Geragos, promptly accepted on her client’s behalf,’ Young said…
“‘A letter requesting dismissal of the charges has been sent to the court,’ Young said. ‘There will be no further court appearances.’ The result is that Hostin’s case is now headed for dismissal, but through the diversion program prosecutors had been offering rather than through the immediate, unconditional dismissal initially sought by the defense.”
Sunny Hostin had previously written to the prosecutor indicating that she was representing the defendant and was seeking a dismissal of a violation “arising from an honest mistake.”
As alluded to above, high-powered attorney Teny Geragos was subsequently hired to handle the case, which seems like an extravagance for such a minor violation.
Sunny Hostin an estimated net worth of $6 million, however.
Geragos, who was one of music mogul Sean “Diddy” Combs’ criminal defense lawyers, charges $800 to $1,500 per hour for her legal services, journalist and The Nerve podcast host Maureen Callahan asserted.
Police bodycam video suggested that Sonny Hostin played the celebrity card when interacting with police.
Already on the phone with her son at the time, Sunny Hostin spoke with cops before heading to the scene, during which she seemed to inform them that she was a co-host on The View (as if that had any relevancy).
She also mentioned that she was a former federal prosecutor, which she repeated after arriving at the rail yard.
Parenthetically, Gabriel’s mommy seemed quite disappointed when an officer told her that her son could not be let off with just a warning.
At the beginning, Sunny Hostin sounded like she advised her son over the device to “tell them your mother is a federal prosecutor” present tense.
On Instagram, The Nerve team asked ABC for a comment.
During her podcast today, Maureen Callahan further elucidated on the question posed to ABC:
“What do you say to one of your employees who is one of your legal analysts who works under the ABC News umbrella, telling her son to say, ‘tell them your mother is a federal prosecutor’… she’s misrepresenting herself. ABC: Is Sunny gonna face any disciplinary action at all? Are you, as a network, going to address this? Because this, to me, seems like someone abusing her position, her fame…”
Earlier in the podcast, Callahan opined the following: “Hey ABC…we’ve got a question we’re waiting for you to answer regarding your employee Sunny Hostin of The View, who says that no one is above the law – except her son.”
