President Donald Trump called on Congress to act after the Supreme Court on Tuesday rejected his executive order seeking to restrict birthright citizenship for children born in the United States to illegal immigrants and temporary visa holders.

Trump reacted to the court’s birthright citizenship decision in a Truth Social post, saying the ruling was harmful to the country but could be addressed through legislation rather than a constitutional amendment.

“The Supreme Court upheld Birthright Citizenship, which is too bad for our Country, but we can easily make it up in Congress through Legislation, with the support of the President, that has now been determined during this process. No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support! President DONALD J. TRUMP,” Trump wrote.

The Supreme Court struck down Trump’s executive order in a 5-4 decision. Chief Justice John Roberts wrote the majority opinion, joined by Justices Amy Coney Barrett, Elena Kagan, Sonia Sotomayor and Ketanji Brown Jackson.

Roberts wrote that children born in the United States to parents who are unlawfully or temporarily in the country are covered by the 14th Amendment’s Citizenship Clause.

“Children born in the United States to parents unlawfully or temporarily present are “subject to the jurisdiction” of the United States and are citizens at birth under the Fourteenth Amendment’s Citizenship Clause,” Roberts wrote.

The ruling leaves in place birthright citizenship for those children and blocks the administration’s attempt to restrict it by executive order.

Trump said Tuesday that Congress should now take up the issue directly. He argued that the court’s ruling showed lawmakers could address birthright citizenship through ordinary legislation with presidential support.

In a follow-up Truth Social post, Trump also discussed another Supreme Court decision from Monday, saying the court had overturned Humphrey’s Executor and restored significant authority to the presidency.

“The biggest and most consequential Decision issued by the Court, by far, is the Slaughter Case, which overturned the very famous Humphrey’s Executor Rule. This whole concept of “Power” has been fought over for nearly 100 years, going all the way back to Franklin Delanor Roosevelt, where a large slice of his Power was taken away. He fought to regain it, even wanting to “pack the Court,” but was unsuccessful in doing so. This Decision gives tremendous additional Power back to the Presidency, where it belongs. It is an Honor to be the sitting President who, after all these years, WON this very important, and hard fought, Case. We had other good Victories, too, and we also had the Birthright Citizenship loss, which we will work to correct in Congress, but the big SLAUGHTER, was SLAUGHTER. The Republican Party was treated very fairly by the United States Supreme Court. Thank you for your attention to this matter! President DONALD J. TRUMP,” Trump wrote.

Trump described the birthright citizenship ruling as a loss but said his administration and congressional Republicans would continue pursuing changes through legislation.

The decision places the future of any birthright citizenship restrictions in Congress, where Trump said lawmakers should begin work immediately on ending what he called “expensive and unfair” automatic citizenship.

The ruling also marks a major constitutional setback for Trump’s immigration agenda, while his response signals that the issue will remain a legislative priority for his administration.
