Trump Says Supreme Court ‘Already Packed’ as He Predicts Loss in Birthright Citizenship Case

President criticizes conservative justices after tariff ruling and warns high court may reject his position on citizenship policy.

President Donald Trump said Wednesday he expects the U.S. Supreme Court to rule against him in an upcoming case on birthright citizenship, while sharply criticizing the court’s recent decisions and ideological alignment.

In a post on Truth Social, Trump argued that the court consistently favors Democratic-appointed justices, stating, “How can the Democrats not like how the U.S. Supreme Court votes. The Democrat Justices stick together like glue, NEVER failing to wander from the warped and perverse policies, ideas, and cases put before them.”

He also criticized a recently appointed justice, referencing Ketanji Brown Jackson, and claimed that Democratic justices “ALWAYS vote as a group, or BLOCK.”

Trump’s comments follow a ruling in the case Learning Resources, Inc. v. Trump, in which the court struck down tariffs imposed under the International Economic Emergency Powers Act. According to Trump, the decision could result in the federal government refunding more than $150 billion. He described the outcome as “unexplainable” and said, “One little sentence would have stoped [sic] this record setting payment from having to be made. It is a travesty!”

The president pointed to the votes of Chief Justice John Roberts and Justices Amy Coney Barrett and Neil Gorsuch as evidence that conservative members of the court are not unified. He said Republican-appointed justices “give the Democrats win after win,” citing both the tariff decision and questioning during oral arguments in a separate case concerning birthright citizenship.

Referring to the pending case, identified as Trump v. Barbara, Trump said he believes the court will ultimately rule against his position. “If they rule against our Country on Birthright Citizenship, which they probably will, it will be even worse, if that’s possible,” he wrote. “It will cost America massive amounts of money but, more importantly, it will cost America its DIGNITY!”

Trump also argued that the constitutional principle of birthright citizenship has been misapplied, stating it was originally intended for “the babies of slaves” and not for other groups.

He concluded his remarks by asserting that efforts by Democrats to expand the court would be unnecessary, adding, “They don’t have to ‘Pack the Court,’ because it is already Packed.”
