A 48-year-old man employed at the Yorktown Rehabilitation and Nursing Center is facing charges of rape and endangering the welfare of an incompetent person for allegedly sexually assaulting a woman who authorities said was unable to consent.
Yorktown Police on Tuesday reported the arrest of Javier Barragan of Shrub Oak in connection with the alleged incident.
Police were summoned to the residence in Yorktown Heights around 7 a.m. for a report of an alleged sexual assault.
Investigators discovered that Barragan allegedly had sexual intercourse with a resident who was incapacitated.
Barragan was arraigned on the felony charges and was remanded to the Westchester County Jail in lieu of $100,000 bail. A magistrate also issued a temporary order of protection on behalf of the victim.
The charge is a felony under the state’s penal code punishable upon conviction by a maximum seven-year prison term in a maximum-security penitentiary.
