Welcome back. We want to get to this developing story.
Lindsay Clancy in court today for a
hearing that could decide if she will face another trial.
Clancy is the Massachusetts
mother accused of strangling her three children to death back in 2023.
Her first trial ended in
a hung jury two months ago.
Kaylee Schuyler joining us now live from outside the courthouse
in Plymouth, Massachusetts, where the court is underway, right?
Yeah, Jen and Bob, we're hearing arguments
on a few different motions today.
And the first that was discussed
was the defense's motion to have the case dismissed.
The defense wants this case thrown out altogether
because of the lone holdout juror, Michael Desernville.
You may remember Clancy's trial ended in an 11-1 hung jury,
the majority in favor of a not guilty verdict.
Desernville has received a lot of backlash since the mistrial.
And Clancy's defense is arguing the judge should
not have ended the trial without digging deeper.
Arguing the juror wasn't following the law on reasonable doubt
Now, the prosecution argues
if the judge had asked further questions, it would have
interfered with the deliberations.
And while Michael has spoken publicly in court,
he's referred as Juror Doe, his attorney this
morning saying this has gone too far.
We are here because Juror Doe did
not vote the way that the defense needed.
So after the mistrial,
the defense went looking into the one juror who stood between them
And the outcome that they wanted.
The judge says he's taking these arguments under
advisement about dismissing the case and will make
a decision as soon as possible.
Now, Clancy was on trial over the summer for the deaths of her three
children. Her defense argued she's
not criminally responsible for their deaths because she was
suffering from postpartum psychosis.
But the prosecution says she methodically planned the
murders. So far, the DA's office has
not stated whether they plan to retry this case. But in a
motion filed last week, prosecutors indicated they plan
to pursue justice for the three young victims,
Dawson and Callen now court is back in session after a quick recess
and right now we're hearing
arguments about a prosecution's motion to have
a gag order in this case. They say to quote prevent
a carnival atmosphere here outside of the courthouse.
Jen and Bob. So this is all up to
the judge today. The judge will decide whether
or not there's they can move forward with a retrial.
Yeah, you're correct and going into court today, we weren't
sure whether if he was going to make any rulings from the bench
or not and it seems like that's not going to happen today.
Again, he says he's going to need some time to look things over
and he'll give us a decision as quickly as possible.
And that gag order is a crucial move because you know this better
than most you've been out there with these court proceedings
and how crazy it's gotten outside the courtroom.
Yeah, it's I will say today is a little quiet.
I think we can safely assume that is because tomorrow is election day.
But I mean, as this trial was happening,
even the hearing that happened on
September 29th, I mean, it is just
a media frenzy around Kevin Reddington.
There are media who will fall.
Everyone's pushing each other,
trying just to get anything out of Kevin Reddington.
So we'll see the prosecution arguing that it's getting too crazy.
But Reddington, of course, is arguing that he has a right to speak.
All right.
We'll watch these proceedings very closely.
Kayleigh, thank you so much.
Thank you.
