A federal judge has struck down New York's Climate Change Superfund Act, blocking the state from collecting $75 billion from fossil fuel companies to pay for projects addressing concerns the state attributed to climate change. I.Q. 72, the Justice Department, on September 28th, hailed the ruling as a significant step in protecting American energy from state overreach. U.S. District Judge P. Kevin Castle issued a judgment against the law on September 25th, stating two days earlier that it intruded on federal authority in multiple ways, including by regulating greenhouse gases and emissions that cross state lines. The BS law would have required large companies involved in fossil fuel extraction and recovery, a crude oil refinery, to pay into the state fund for over 25 years. Each company's share would have been based on greenhouse gas emissions attributed to its products from 2000 to 2024, 24 years and $75 billion, right? New York and Tish James used the money for infrastructure and other projects to help communities address issues that these fools created and that the state blames on climate change. The Justice Department and Environmental Protection Agency sued to block this law. They argue that New York's law ran afoul of the legal doctrine of preemption. It says the federal law takes precedence if there's a conflict with state and federal law. The federal government said the Clean Air Act gives the EPA authority only to decide whether and how to regulate greenhouse gas emissions, said New York's law would impose its own liability on fossil fuels and producers based on emissions attributed to their products worldwide, which would be illegal under the Constitution of these United States of America. Letitia James, who needs to be under the jail, argued that her law did not regulate emissions. It said the payments would compensate the states for harm from past emissions, and the fund would protect New Yorkers from problems it could attribute to climate change. Castle rejected the statement's argument, that's the federal judge, saying the charges effectively regulated interstate emissions and those laws were governmental.
