Welcome back to TMZ Sports, Babcock here with Luca Dillon and we got a very special guest,
Derek. Derek in the house. We got a legal story here. This is fascinating, fascinating stuff. So
Jake Paul got a message for HBO. You can take your cease and desist and, you know,
put it where the sun don't shine. Because a couple of days after the network sent him,
fired off this legal letter demanding that he not run any more entourage-like ads,
his Better Company is out with a new one. Now, if you hadn't seen the original,
it was 10 days ago when Better, his gaming app, released this entourage spoof.
Jake, my brother, how are you? Good to see you. How's the job? You okay?
They let anyone into my party? Yes, they do. Is this all yours?
Don't touch me, by the way. Yeah, of course this is mine. Congratulations.
Better Picks was just the start. Now we're live in over 30 states with over a billion
dollars paid out, Mr. Money Man. How is that possible? Okay, so there it was. Jeremy Pippen
was in the ad. Adrian Grenier was also in the ad. Obviously, Vinny Chase and Ari Gold. They never
used the characters' names, Derek, but HBO was still very upset about this. Again, they send
this letter. They say, take that ad down. So not only does Jake not take it down, but he comes out
with a new one yesterday. Real dealers. Real dealers at the table. She know I came to win.
It's free spins. Free spins just hit. Now we running it again. Pomegranate. Pomegranate in
the glass. Better purple to the rim. How long can this guy go on? Better casino on my phone.
I'm going to Orleans. So there it is. It's clearly out there. You know why HBO's upset. I mean,
that's very obvious. They're trafficking in entourage, right? I mean, it looks like Ari
Gold. It looks like Vinny Chase. They clearly wanted people to think of that. That's why they
hired them for the ad. They don't use their names, which was indicated to me that they got some
advice from lawyers before they went ahead with this commercial. Because you can't just, you know,
protect an idea, an archetype of someone. He's a brash agent. He's an easygoing, you know,
celebrity or actor. That's not protectable. So they look like they knew what they were doing,
and that's why they're thumbing their noses. Here's another ad with an agent character and
a laid-back guy. You know, it's funny, Derek, because we posted the original ad on the website,
and I heard from somebody who works with Better, and they asked me, they say, hey, can you
say if they didn't, you know, kind of take, you know, what's that word? Can you say they
didn't reprise their roles? They didn't want- Yeah, don't play off that. It's entourage. The
reason is because it doesn't confuse the public. The idea is, is this falsely endorsing, like,
making it look like HBO is behind the ad or the entourage producers are behind the ad?
You don't want that. So you don't want them to file a lawsuit where they put up a bunch of
exhibits saying, look how the media picked it up. It's obvious. This is Ari and Vinny. So,
like, they are clearly confusing the public that we're behind this. But I think they did a good
job. It's funny. At the end of the day, I don't think HBO will really go to the mat for this. I
don't think Doug Allen really liked it. He seemed to, like, not be a fan of the ads. But I think
they did a good job. They get legal counsel. Yeah. I mean, ultimately, Jake Paul makes this
commercial because he wants, like, guys to watch this and go, oh, man, let me repost this and send
this to my buddies. It's Vinny and it's Ari back together. Like, that's what you're trying,
yeah, that's what you're trying to do. And then you're like, oh, there's this app out. And then
that's a successful ad. Look at the way he's dressed. He's dressed like Ari. And how he's
talking. How he's talking. Every gesture. I will say one thing they didn't do as well,
other than not using the names, there was no let's hug it out bitch, which was a big catchphrase. If
you delve into catchphrases, if you had a Bart Simpson saying I caramba or something in a
commercial, you could get in trouble. You could have to listen to the takedown. But I think they
did it carefully. I'm all for it. If he would have yelled for Lloyd, it would have been.
Just watching that did give me, like, warm feelings. But also,
maybe you're going to go watch it again. It's good for you. It's all about perspective.
TMZ history. We made it happen. We're a big part of that even coming to fruition. So I
think there's been enough time. Let's see. Yeah.
