Boston 25's Legal Analyst looks ahead to Day 6 of jury deliberations in Lindsay Clancy trial

Thank you. Now, we're still waiting on a verdict, so let's bring in Boston criminal defense attorney Elyse Hirshon. Elyse, good morning. Good morning. So, we know jurors have had a hard time coming to a unanimous decision. If they come back again for a third time, what does that mean for the trial? If they come back and say that they cannot continue to deliberate, that they cannot come to a unanimous decision, then they are not allowed to be sent back to deliberate again unless they specifically ask for it. The Tui Rodriguez instruction that we heard yesterday has very strict rules not to send them out another time if they come back deadlocked. Okay, so we just heard a soundbite there from Reddington and Ryan's report saying he would do this again next week. That's not likely, right? It's very unlikely that it would happen that quickly, but that just shows his level of confidence, his level of knowledge about the case, and his desire for this to be over for his client, for everybody. It's a very emotional trial, and this trial would not be ideal for everybody involved. The length of the deliberations now, 30 hours, what does that tell us, aside from the obvious that they can't reach a decision? It tells us there are very strong opinions in there, either for or against. Now, remember, it's a complicated verdict for them. There are a lot of options there, and it's for each child, so they could be on total opposite ends for every single one, first degree, second degree, manslaughter, not guilty for criminal responsibility, or they could have already eliminated a couple on there and only be down to two options. We don't know, and unless they write that down and tell us, the judge cannot inquire, and we won't find out until after the trial.
