WAWAYANDA – The State Supreme Court in Goshen has tossed two legal challenges to the large, five-story Amazon distribution center proposed in the Town of Wawayanda.

It was believed to be a dead issue after the town planning board and zoning board of appeals locked horns over two issues.

Lawsuits challenging two key points were argued in Supreme Court and Orange County Partnership President Conor Eckert says both have been dismissed.

“The court actually dismissed Article 78 challenges – the one challenge was for the negative declaration of the site plan approval; the other was for the height exception,” he told Mid-Hudson News. “So, the courts dismissed both of those challenges which means the project is approved for that height, actually.”

Before the project could move forward, the issue of financial incentives from the Orange County Industrial Development Agency must be resolved.
