NEW YORK – State Attorney General Tish James’ Office of Special Investigation has opened an investigation into the death of 39-year-old Marcus Burks of Newburgh who died on January 1 following an incident with police.

The attorney general’s office said it previously conducted a preliminary assessment of the matter but opened an investigation following the receipt of new information. The nature of that information was not disclosed.

The began at around 10:30 p.m. on New Year’s Day when a state trooper had spotted Burks driving with a headlight out while on Route 17K in the Town of Newburgh.

Burks allegedly failed to pull over and continued driving at a high rate of speed driving into the City of Newburgh where he was involved in a crash with another car on Broadway.

Police said Burks got out of his car and the trooper and other officers attempted to restrain him at which time he became unresponsive and was taken to the hospital where he was pronounced dead.

Pursuant to state law, any time there is an incident where a police or peace officer, or corrections officer, may have caused the death of a person by an act or omission, the attorney general’s office will conduct an investigation.
