CARMEL – In 2013, Putnam County placed a 16-year-old girl living in foster care in a residential treatment center for girls and young women where a teacher allegedly sexually abused her.
The Appellate Division of State Supreme Court has reinstated the young woman’s lawsuit noting that the presiding judge blundered when ruling in March 2014 that the county and the St. Anne Institute in Albany had “lacked notice of [the] instructor’s sexually abusive conduct or propensity to engage in such conduct.”
The magistrate also denied a petition for the alleged victim to reargue the case, which the woman filed in 2021 under the state’s Child Victims Act. The law opened a two-year window to sue for alleged sex crimes in which the statute of limitations had expired.
