AI GeneratedLee Gillie, a 39-year-old man accused of killing his pregnant wife, Krista Gillie, may be extradited from Italy to Harris County. An Italian court has granted extradition, but only on a lesser murder charge rather than capital murder, as Italy does not recognize the death penalty or life without parole.
We are talking about Lee Gillie, and to give you an idea,
he's the 39-year-old man who was accused of killing his pregnant wife,
and then he fled to Italy.
Now, he pled not guilty to charges of capital murder
in the death of his wife, Krista Gillie, and we do know
that he now faces a lawsuit from his dead wife's parents.
But now there are some new developments showing
that an Italian court has granted extradition
for Lee Gillie to Harris County on a lesser murder charge.
So we have his attorney with us right now.
And I wanted to bring you up, sir.
So let us know what you think, Dick DeGaren, thank you for being here,
in terms of what the Italian court granted and what now
the future would possibly be like for your client, Lee Gillie.
Well, the order from the Italian court is 56 pages long.
I don't have time to go into it all.
But what they said was they will not extradite him for capital murder.
they will extradite him for what's called murder in Texas,
which is a lesser offense
that has a wide range of punishment.
And have you been able to talk to him since
this whole development has taken place?
Well, I just got it this morning. No, I have not.
I'm sure I will. Sorry, I didn't mean to cut you off.
That's all right. I was going to say,
can you just explain to us what you all
were waiting for from the Italian court and also
what Lee Gillie has said to you in terms
of cutting off his ankle monitor and fleeing over
to Italy and why he did it?
Well, I can't answer the second part of it, but I can say that what
we were waiting for was a decision from the Italian court
on whether they would grant extradition.
They do not recognize the death penalty, and they do not recognize
the sentence of life without parole or without chance of parole.
And so the question that they posed was, is there a realistic chance
for a lesser sentence based on rehabilitation or good conduct?
The answer to that is no, not in Texas.
And so what they've done is they've issued
an order that he can be extradited
for the lesser offense of murder. So what are the next steps now?
Well, both sides have a right to appeal the latest order.
I'm advised that the Italian
lawyers will appeal. They have 15 days to do that.
And then there's an appellate court in
Italy that will decide the matter.
The government can also appeal, and I don't know whether they
will or not. With all of these possible things that could happen,
what is the time frame we're
looking at here that we could see legally here in Harris County?
I don't know. Any appellate
process takes a while. In Texas,
I could give you a better idea of it, but I don't know in Italy
what their appellate process involves
or how long it takes is there anything else that's
developed that you know about that we should know
no not as far as the criminal case is concerned
all right well thank you
so much for your time i appreciate it thank you all right and uh that
was Lee Gillie's attorney Dick DeGaren
and we were able to speak with him live there again like
i said the italian court has granted extradition
for Lee Gillie to return back to Harris County
and it would be on a lesser murder charge.
Again, he is accused of killing his pregnant wife.
