Welcome back, welcome back.
Visitation can get complicated in child custody battles,
but does it apply to adults as well?
That's the question we're asking. Our legal expert
here to explain what happens when families argue over
who gets to see a parent, grandparent,
or other loved ones, who gets to see the child.
It does not seem like something that would make
its way into the court, but it absolutely can.
It does on a very regular basis. People are in
probate courts arguing over, you know, I didn't get a chance.
I tried to stop by after church
and see mom and she locked the door.
She turned off the phone. I can't call. It happens on a
regular basis. Jay Hunt Crump Gibson, everybody.
Hello. Hello. Looking fabulous. Okay. Let's get
back into it. Grandparents don't necessarily have
a right to the grandkids. Yeah. Grandparents
rights are like not really a thing.
I mean, they, they are, but they aren't. So certainly if you're
mad because your daughter's not letting you see
her children yeah you can't run into family court
and then say hey i need to be able to assert
my rights the rights are for the child to the parent
but it is a conversation that's happening across the country
because it's not just oh we got into
it yeah and now they don't let me see
the grandkid it's sometimes my child passed away and so the kid
is with their mother
and the mom doesn't let me see right you know right see my grand see my
grandchildren right right and it's a thing i think i see it
in that context but i also see it in a lot
of situations where grandparents have stepped
in and they actually are caring for the kid
because there's something going
on with the parent right they don't have a stable life
you know what i mean they're constantly bouncing around they got
a new boyfriend or girlfriend this
day so they're moving in and that's not stable for the kid right
so the grandparents are stepping in
trying to say hey like these kids need a stable environment
so actually just like give them to me
so that also happens so what do you do what
do if you're looking for guardianship or if you want
the courts to just take a look at your situation what
are you recommending you file a petition with
the court i think before you do that though you
should sit down and talk to a lawyer because
they're going to spell out what you would have to prove
so in that situation that i mentioned with
a grandparent trying to get guardianship of a child
that's in an unstable, unsafe situation.
If those factors are demonstrated to the court and it's like,
hey, this kid's safety, right,
is at issue, then maybe they might think about granting guardianship.
But then the point is to
make sure that kids have relationships with their parents.
So even if they place them with somebody
else temporarily, they're still going to want
to encourage the parent to be involved, right?
Right. Because that's what the court
cares about. Like at the end of the day,
that we're here right despite what kind of person
this is that's still this child's parent
what about documentation yeah what kinds of i mean
that feels real shady when you're you know
when they're when your kids are involved yes yes anything
that you can think of so a lot of times
evidence ended up being attached you know text
messages dms you know things that people posted
in their stories and somebody took a screenshot
of all the time all those things end up being
evidence so exactly exactly look what she
was doing the other day look at this paraphernalia
that's in the back of that story or she's over here drinking
and doing this yeah that's not an
environment that this kid should be in so yeah
so people like watch what you put out there on
the internet i mean can you talk about this is more
of a common issue than people might it is
it is a regular issue whether it's from the kids right to the parents
and a lot of times we know
when it comes to child custody battles a lot
of times it's not even about the kid it's about the
people's issues, the adult's issues, right?
So that happens on a regular basis. But even when
it's coming to grandma, grandpa, mom, and dad,
when they're older, at the end of the day, just
because people are not getting along,
whether it's a vulnerable adult or a child, they shouldn't
suffer. So just know that that's what the court
is going to care about when you go in there. They're
not going to care about your argument at Christmas.
They're going to care about what's best for this
kid or this older adult. Yeah. Okay. Where can we find you?
