BREAKING NEWS: Judge declares mistrial while defense seeks emergency stay in Lindsay Clancy trial

Over the defendant's objection, I'm going to declare a mistrial at this point. The jury in the trial against Lindsay Clancy cannot reach a verdict. That judge announcing about a half an hour ago that he intends to declare a mistrial. So right now he's giving it until about 12.30 this afternoon, allowing for the defense to request the state supreme court for an emergency stay. Friday afternoon and the big story on Action News is breaking news in the Lindsay Clancy case. These dramatic developments playing out just a short time ago. The jury returned today for a seventh day of deliberations. Tensions flared yesterday as the defense requested to have one holdout juror removed, claiming they refused to follow the law. ABC's Olivia Rubin brings us up to speed on this pretty wild morning. A deadlock in the Lindsay Clancy murder trial. It is with a heavy heart that we report we are unable to come to a unanimous decision and will not be able to. The jury unable to come to a unanimous decision on the charges related to the killings of her three children in 2023. The judge declaring a mistrial but holding off for one hour at the request of Clancy's attorney so they can appeal, calling it a travesty. Clancy had pleaded not guilty and asserted an insanity defense. Her husband, Patrick Clancy, testified he left home the night of the tragedy. When he returned, he said he found his wife injured in the yard after attempting suicide and his three children strangled in the basement. She remains paralyzed from the waist down due to the fall. Patrick Clancy telling the jurors his wife's mental health deteriorated in the months before the killings. She described thoughts of hurting kids. During the trial, defense attorneys arguing she was suffering from postpartum psychosis. The severe mental health condition they say left her legally insane. One of the key witnesses for the defense, psychologist Paul Zeisel. He's met with Clancy about 60 times, beginning just 11 days after the killings. She had said that she heard a male voice ordering her, telling her that she didn't have any choice but she had to kill her children and then kill herself. But prosecutors argue Clancy acted intentionally, rationally and swiftly to kill her children. Calling numerous medical professionals to the stand who testified about their interactions with Clancy after the killings. Olivia Rubin, ABC News.
