Just minutes ago the judge in the trial telling the jurors to keep deliberating
after admonishing them to remember the legal meaning of quote beyond a reasonable doubt.
Fox 5's Teresa Priolo has been following this case closely and joins us now with the latest.
Teresa.
A lot of drama in court today Lisa.
Certainly an explosive day as these deliberations exceed 36 hours in the Lindsay Clancy murder
trial.
So as Lisa mentioned today a note from the juror forces prosecutors, the defense attorney,
the defendant, Lindsay Clancy and the jury to be called up to the judge's bench for a
sidebar conference.
So here's how it all went down.
Around 2 30 this afternoon the judge called both parties to the bench and although it
wasn't done in the view of cameras courtroom reporters say defense attorney Kevin Reddington
was yelling at the judge.
At one point the Commonwealth's team looked very upset.
The judge handed Reddington papers that he then tossed aside or maybe threw to the ground
and then Kevin Reddington walked over to Lindsay Clancy who was paralyzed from the chest down
and wheeled her up to the bench before they were brought back on record.
Each juror individually called in one by one to answer a few questions by the judge.
What followed were these comments from both parties.
The issue appears to be one juror does not want to follow the judge's verdict instructions.
Juror the court has an instruction from the foreperson of that juror that's been working
for a week now saying that there's one juror who refuses to listen to the law that you've
given him or her on reasonable doubt and I suggest respectfully that the soft instruction
that you gave them saying at the sidebar can you listen to the law as I instruct you does
not focus on the issue.
It is the question is not sufficient enough it does not allow any foundation for a motion
to remove remove the juror who refuses to accept your instructions on the law on reasonable
doubt and if we come back here in a half an hour with a mistrial because of a because
of a juror that has just spurned the instructions of this court it's a shame it's a real shame.
I think what your honor has done by asking each juror if they're able to follow the law
and then giving a general instruction on reasonable doubt is appropriate um under
Commonwealth versus Ralph so we do not have an objection to what uh the questions or the
re-instruction. Now this all follows two other notes over the last few days with the jury
saying they were deadlocked on a verdict. A reminder that Lindsay Clancy is accused of
murdering her three small children. She says she was suffering from postpartum psychosis
at the time and therefore can't be criminally responsible. The Commonwealth claims she planned
the murders and she knew what she was doing. Now we don't know what the opinion is of the
juror in question. The judge refused to excuse that juror. The jury was sent back into deliberation.
