With the Lindsay Clancy jury facing a possible deadlock, legal analysts are weighing what could happen next. Could there be a hung jury? A mistrial? A retrial? Boston 25 News breaks down the possible outcomes as deliberations continue in the high-profile Duxbury murder trial.
I'm Boston 25 news reporter Daniel Coats on scene in Plymouth where day five of
jury deliberations once again wrapped without a verdict. The judge though
giving one final push to those 12 to come up with a unanimous decision.
I wouldn't be surprised if they came back with a verdict if they said that
they wanted to continue or they want to stop. Another day another deadlock for
the jury deliberating the Lindsay Clancy triple murder case. So it sounds like you
Her defense will have to wait some more though as the judge gave the Tui Rodriguez
instructions Wednesday afternoon. It's the judge's final push to the jury to
keep deliberating. It's your duty to decide the case if you can do it
conscientiously. The judge is saying hey come on try a little more and to push
and prod and pressure them a little bit because you don't want all these weeks
of trial to go for nothing. Boston 25 legal analyst Peter Elbekin said this
instruction likely won't change the stance of jurors but it puts the heat
on the 12th for the final time because they've been kicking this around for
days and it just may not be that much more to talk about. At some point you
just have to put your hands up, throw in the towel and say that we're not
going to come to a decision. Elkin said the judge could send the jury back a
third time only if they agree to continue deliberations which is
unlikely. If they can't come to a verdict, the judge could declare a
mistrial. Prosecutor can decide to just drop the whole case, not go forward.
That's not real likely. The prosecutor can um we try the case or the
prosecutor can say, hey look, let's compromise, let's work out a deal.
Outside court defense attorney Kevin Reddington said Lindsay is struggling
and waiting anxiously for the jury's decision. If there is one, one thing is
for most of her Children. The judge ordered the jury to return back here to
court in Plymouth on thursday morning for day six of deliberations. Meanwhile
Elkin told us it's unclear how long deliberations could last after the two
rodriguez instructions are read. It could be hours or it could be days on
scene in Plymouth. I'm Daniel coach for local station Boston 25 News.
