just cuz he got the pardon if Republicans want to they could still demand he testify against Jojo and other family members about the dirty Deals they did with barisma and the Chinese Energy company and all that stuff correct or am I wrong I'm not a constitutional attorney yeah so look uh you know first of all Dan great to join you as always so you know the subpoena power is totally independent of of whatever the Parton power may or may not be and you know unfortunately I think that the Biden doj is probably wrong in their constitutional challenge to this part and I wish it were not the case there he probably does have the actual authority to issue a pardon of this sweeping nature but that has nothing to do regardless of whether or not the doj or Hunter is right on that that has nothing to do with the subpoena pow so you know come January February 2025 House Republicans Mike Johnson they can 100% use their use their subpoena po so can incoming Senate Majority Leader John th if he is so inclined they can use their subpoena power all they want to try to reop investigations against Joe Biden Jim Biden and all the above there it's actually even even more than that because if I understand the paron correctly because Hunter Biden has has accepted this pardon he's voluntarily accepted this pardon there I'm actually not even sure that he can invoke the the Fifth Amendment my next question right you can't how can you say I plead the fifth because you don't have to protect yourself you're protected with the pardon exactly so I I mean to be clear we've probably never been in the situation before I mean as with as with many things in our legal culture these days and we're very much in uncharted waters so I mean I mean it might end up being decided by the US Supreme Court there but I I don't see any legitimate Fifth Amendment reason for him to be able to invoke the fifth and not be able to testify there now you know I'm sure he would muddle his answers and I'm sure he would say some sort of thing to try to gum up the works and to obus skate to try to make house for Senate Republicans jobs a lot harder there but constitutionally he has no legitimate basis whatsoever to be able to invoke the fifth there it is something of a novel legal question as to whether you can do it if you don't actually face a threat of prosecution certainly if you want to go with with originalism which is kind of the broader kind of right up Center Preferred approach to constitutional interpretation there is no original meaning that I can possibly discern that would allow you to do so absent the possible threat of prosecution that's the entire purpose for this provision in the first place there so I don't think based on my reading of that he would be able to invoke it there but again it really is uncharted waters President Biden insisted many times he would never pardon his own son for his serious crimes but like last night he suddenly granted a full unconditional pardon for any and all offenses that Hunter committed for more than a decade trust in our justice system it's been almost errly damaged by the bidens and their use and abuse of it real reform cannot begin soon enough so I don't know if that's a little Prelude to something that the speaker might be doing next year but I think the American people who have watched this disregard for the law for our constit constition for the rule of law since the Democrats love that phrase right for the last four years rule of law rule of law um I think we need to see somebody's ass in the hot seat and we want to see people pay for what has been done and this family use their position mainly Joe's as vice president and a senator for decades to enrich themselves giving deals to these foreign energy companies and countries which didn't benefit the American people in some cases maybe some of the bills that he pushed for as a senator or helped to approve under Obama when he was VP helped the other country more than helped America so he could enrich himself and his family and for that I'm sorry somebody should go to damn jail Dan I I I view the Biden crime family here very similarly to how I view Jack Smith and Merck Garland entire Democrat law fair complex more generally which I am sick I am personally sick not just as a conservative not just as a constitutional I am sick to my stomach as an American citizen and God-fearing Patriot of living in a country that does not have accountability when Grievous things go off the rails without accountability when things go very very wrong we cannot possibly learn from our societal mistakes from one individual's mistakes from one party's mistakes whatever and possibly move forward
