A judge has delayed a murder trial in Lowell for the second time over concerns with a statie who investigated the case and has been accused of driving drunk during a fatal cruiser crash.
The first-degree murder trial of brother Billoeum, Billy, and Channa Phan will continue to a status conference in June while their defense lawyers and prosecutors sort out any potential prosecutorial issues caused by Sgt. Scott Quigley’s involvement in the case.
Last month, Middlesex County prosecutors informed the Phan brother’s attorneys that Quigley may have been drunk when he crashed his cruiser head-on into a wheelchair van in December 2023 in Woburn. An occupant of the van, Angelo Schettino, was injured in the crash and died in the hospital about a month later.
The judge had initially delayed their trial until April, but following the disclosure of more evidence, dash camera footage published by the Herald and a disclosure that someone in the Middlesex District Attorney’s Office knew about Quigley’s blood alcohol level over a year before its disclosure in court — made that date seem untenable.
The status conference for the trial has been scheduled for June 2 while a bail hearing for the brothers will be held March 13.
The Phans are accused of killing Tyrone Phet in Lowell in 2020. This is the second time the case has gone to trial. The first proceedings ended in a hung jury.
