All right, we're going to start with that story for Sacra Gray.
Remember, you can also send us a text at 713-581-9914.
So we're told by police that a man was shot
and he was wearing a mask on a Halloween costume
and it was basically a case of the wrong apartment.
It turns out he does, in fact, live there, but was at the wrong door.
Sacra Gray joining us with that story now.
And Sacra, I understand this man
is 36 years old and in critical condition.
Yeah, he wasn't wearing a mask,
police tell us that he was wearing what appeared to be a dumb and
dumber Halloween costume, so an orange suit and a top hat.
So when we think Halloween costume,
that's not really the first thing that comes to mind,
but that's what they said that costume
looks like. And to paint a picture of what last night was like,
okay, so imagine this,
imagine you're inside your apartment,
you're sleeping and all of a sudden you hear commotion
at your door. You realize that someone
is trying to get into your apartment.
So then you hear them rattling the door handle,
kicking the doorframe, and
you spring into action because you've got a girlfriend
and a one year old baby at home.
Well, that's what one resident describes happened
at two o'clock this morning here
at the Phoenician apartments in the Galleria area.
So investigators tell us that the man outside the door
also lived at this apartment complex.
They say he was coming home from a Halloween party
in what appeared to be that dumb and dumber
character Halloween costume.
They say he may have been drunk and that's why he may have
mistaken that apartment unit for his own.
Meanwhile, as we said before, it was a scary
situation for the family behind that door.
As they say, the man of the house, he saw the stranger
He threw his peephole and then he grabbed his firearm.
He described to us exactly what happened.
He was like, this is my house,
this is not your house, bro, and then he's trying
to bum rush and force in, I pushed him out,
I asked my girl, did she know him?
She said she didn't know him.
And as I'm turning around
and look back at him after asking my girl, he hit me.
After he hit me, he tried to, I guess,
take me down or whatever, and that's when I ended up shooting.
First instinct, make sure my son and my girl are okay.
He says he fired a single shot,
which police say hit the man in the upper torso.
They say the man was transported to the hospital in critical condition.
Now, Fox 26, we were out here.
We took a look at exactly where this all happened.
So just outside of that apartment unit door,
it is still a graphic scene out there.
The crime scene tape was still up when we were out here on the scene.
So keep in mind, a family is still continuing
to process what just happened, and a man is
still fighting for his life in the hospital.
Back to you.
Sacro, wow.
To get that interview and have that conversation with the man
who fired the weapon is incredible
to actually hear his account of what happened.
Now let's talk about the guy
who police say went to the wrong apartment, right?
So if they're saying it's possible
that the man outside the door was confused about the
apartment, is there a chance now the resident
who fired his weapon to protect his girlfriend
and his son, could he possibly face any charges?
Yeah, Anthony, that's a great question.
We had the same questions. I spoke to our legal analyst.
We heard from police that they hadn't filed any charges yet.
But our analyst breaks down
why those charges may never be filed.
Take a listen. At night when someone's coming into
your house, you do not have a duty to wait
and decide if it's a mistake or if this is just some
drunk guy. You can take action to defend your property
and yourself and that includes deadly
Yeah, as we head into Halloween weekend,
this is all a stark reminder that, hey, it is fine to go have fun,
but it is also critical for you to be aware of your surroundings.
And, hey, if this story can be a reminder to anyone,
make sure that you and your friends get home safely.
Make sure you watch them walk through the door with your very own eyes.
Wow, Sakura, thank you so much for that report here.
Really interested to see where that one goes as well.
One viewer says they better not charge that man because,
again, the position here is that self-defense.
Someone was trying to get into his apartment there and he fired
because he has his girlfriend and his son in there.
Another viewer here on TikTok says that's a tough one to decide.
We will see what happens in the future.
