A man shot by ICE agents in Marble Hill says
the masked officers never identified themselves.
That's right. His lawyer is questioning
if the agents had a valid warrant as well.
Jessica Formoso with those details.
Jessica, what are you hearing this morning?
Good morning, Dan and Rosanna.
28-year-old Oscar Belgal remains
at the Metropolitan Detention Center in Brooklyn.
A federal judge yesterday gave federal prosecutors until Monday to
justify why he should remain detained while he fights his deportation.
This, as Legal Aid Society, who is representing him,
filed a petition arguing that Belgal had no idea that they
were ICE agents saying the arrest was unlawful.
They say ICE agents had no valid warrant to arrest him
when they approached his vehicle near West 225th Street
and Marble Hill Avenue on October 8th.
According to the petition,
they claim masked ICE officers in civilian clothing approached his car
with firearms without identifying themselves or presenting a warrant.
According to police, they fired at least seven shots,
striking him in the neck.
Video from that day shows one of the ICE agents wearing plain clothing
and a yellow vest holding a long gun.
The Department of Homeland Security says Belgal drove his car
into ICE agents' vehicles as they tried to arrest him,
prompting them to open fire.
In the backseat was his five-year-old son.
His attorneys disputing that claim saying there
is video showing Belgal pulling his vehicle forward, not backwards,
towards the officers as he attempted to escape the gunfire.
Homeland Security officials say he is associated with a robbery crew,
had multiple prior arrests, including grand larceny,
and had ties to the Trinitarios gang.
His attorneys also say he is in need of surgery to remove that bullet,
and therefore they are asking for his immediate release,
claiming he is not getting
the medical care needed at the detention center.
This, of course, is not the first ICE-involved shooting.
After a series of contentious shootings
and aggressive arrests by ICE officers,
A report by the Government Accountability Office is suggesting
that ICE officers wear body cameras that automatically activate
when an officer pulls their weapon.
Critics say that the cameras could help with the transparency
and also holds officers accountable.
But federal immigration officials are rejecting the recommendation,
saying it could risk privacy concerns.
Dan, Rosanna.
Thank you so much, Jessica. We'll be tracking that one for sure.
