AI GeneratedCJP leaders Saurav Das and Ashutosh Rangka were detained following protests at Jantar Mantar, which was recently denotified as a protest site. The incident has sparked a fierce debate over the right to dissent, allegations of electoral fraud and voter list manipulation, and the balance between maintaining public order and upholding fundamental constitutional rights in India.
Welcome, you're watching
the Urban Debate where Kofro Janata Party leaders like
Saurav Das and Ashutosh Rangka
who have been now sent to five-day judicial custody and have
been lodged in the Tihar Jail hours after being
placed under preventive arrest. Saurav Das has
been lodged in Tihar Jail No. 2
and Ashutosh Rangka has been lodged in Jail No. 4. Now,
this follows a major standoff at Jantar Mantar after
the location was officially denotified as
a designated protest site.
Despite the ban on political gatherings at the venue, the CJP
leaders staged a protest, a flash protest on the grounds,
triggering immediate police action and
detentions and also FIR invoking criminal trespass
and disobedience of the orders. Five-day jail for
Saurav Das and Ashutosh Ranka where the police claimed
that there has been a breach of the peace
bond that both of them signed and the CJP leaders
who disturbed the peace of a public place and
accused of mobilized protesters.
Both had to plead to avoid such activity and within a week of signing
the peace bond. Well, it has been violated,
according to the Delhi police that pressed
heavy charges in court, citing a severe bond breach.
And also the police have alleged that
both leaders actively mobilized protesters,
disturbed public peace and violated prior
pledges to avoid any such activity.
The defense, however, pushed back sharply, representing the
CJP advocate, accused the police of misleading the court,
stating that the leaders were sent
to custody solely on the presumption that the police said
that they can commit a crime. However,
but no public announcements were made of such.
that the officer who molested a female journalist
is being charged against a police officer.
Why wasn't he arrested?
Why wasn't there any action against those goons
who are beating women on the road?
Those people who are openly committing crimes on the road,
and, okay, I don't want to take anyone's name,
but the people who are openly committing
crimes and roaming on the road,
there is no action against them.
Meanwhile, the third co-accused, Ajinkya Shinde,
has been granted bail after furnishing five thousand rupee
bond alongside one year undertaking to maintain public peace.
So Saurav Das and Ashutosh Ranka, however,
that they have remained in the Tihar jail as far as this custodial,
the judicial custody is concerned.
And when it comes to the political fallout,
where the CJP leader and founder, Abhijit Dipke,
who's now hit out of the government and the police,
where he's claiming that their only fault was displaying
the tricolour at Jantar Mantar and it is not a crime.
He says that the government is determined to crush dissent
and it should have the courage to officially declare an emergency
instead of resorting to what he called as cowardly tactics.
On the other side, Lok Sabha
LOP, Rahul Gandhi, who has
also weighed in on the Jantar Mantar
flash stir, where he has extended solidarity
with those raising their voices, while Rahul
Gandhi has not named CJP or their leaders
who have been sent to judicial custody.
However, he has strongly criticized the action,
saying that waving tricolour at Jantar Mantar
does not amount to a crime
and jailing youth for this act is an act of cowardice.
He says that students, youth, journalists are united in this one cause
and the citizens are demanding for their constitutional rights.
Also, he has asserted that Jantar
Mantar belongs to the people of India.
The voices
in the opposition
are also backing the CJP.
The question being raised is simple.
Is waving a tricolour at Jantar Mantar a breach of peace?
Opposition leaders are questioning how
many young voices will be silenced,
calling the preventive arrest to be bizarre
and accusing the BJP of acting as ECI's mouthpiece.
They say that the fight is over the right to dissent
in asserting that India will be reclaimed
from those who accuse of misusing power.
The economic situation of the United States,
especially the economic situation, is very bad.
The level of the Prime Minister has increased
in the minds of the people.
His image was completely destroyed.
So the same situation was in 1975 during the emergency.
Today, the arrests have begun in the same way.
Now they will start arresting big politicians.
No party should think,
no politician should think that his number will not come.
The government of the country is scared
because they say that the parrot has its owner's life.
In this way, why is Gyanesh Kumar being protected
by the entire troll army of the Indian People's Party, the leaders
of the Indian People's Party, why is he not protecting Gyanesh Kumar?
Why has he become the leader of the election committee?
This is not a matter of any political party.
This preventive arrest
is bizarre.
What is the complaint?
Trespassing by the JDU.
Nitish Ji is somebody who came out of the student movements.
He is somebody who was part of the JP Andolan
He is a Ram Manohar Lohiaite.
Does he support this trespass affair against young people trying
to wave the Tiranga?
Yes, at Jantar Mantar, if he does, it's truly a sad day for the JDU
and even sadder day for Indian democracy.
Well, the BJP meanwhile has hit out at the CJP,
calling it to be Aam Aadmi Party's B-team.
The scathing attack that is coming
in from Delhi Chief Minister Rekha Gupta,
asking the CJP that why not visit Punjab and take cognizance
of the matters that have been prevailing in the state.
Now, because of this drug, the murder that took place yesterday,
should the BJP go to Punjab to protest?
Why does the Aam Aadmi Party act as a B-Party
and work only on the same political agenda
that the Aam Aadmi Party conveys to them?
Let's open this up and introduce Anuja Kapoor
from the BJP joining us here on the open debate.
We have Abni Bansal from the Congress Party as well,
Rajiv Chaudhary from the Aam Aadmi Party,
Ashutosh Sivasivji who is a lawyer
and Harish Mohammed Ibrahim who is also
a political analyst. Thank you very much
all of you for taking out your time
I want to understand from you Rajivji
what all has happened and
transpired at Jantar Mantar which has now
led to 5 days of judicial custody
of Saurav and also of
Ashutosh. What does it
really exactly what had happened
on part of the actions that has been
undertaken by the Delhi police
does it actually amount to breach of peace?
This is absolute
collapse of democracy the government is so scared
of the students protesting over there
that they are not allowing people to go there with tricolors
and what was the fault of Ashutosh
Ranka and Saurav Das who went there
at the Jantar Mantar they just went there with tricolors
is flagging a tricolor at Jantar Mantar
an offense we have seen many videos which are
being circulated on the social media there have
been people betrayed by the government who have
been beating females, beating students over there.
They have not been yet arrested. On
the other side, the CJP, Saurav Das,
Ashutosh Ranka, they were arrested. They were sent
for five-day custody in jail. What was their fault?
They were just demanding a free and
fair election. They were just demanding answerability
from the election commission. They were just
answering certain doubts
which were raised by the Indian Express reporter. And till date,
the election commission has not been
able to come forward and address a single
press conference on this issue
election commission
in the supreme court
said that this form
6 was brought into the
notice of supreme court and it was
approved by supreme court which was later
found out to be untrue
supreme court itself said that this form
6 was never brought into our notice
we never considered
this form 6 notice we never
approved this form 6 notice
What else proof do we need for this now?
And when it was caught red-handed,
the election commission was caught red-handed,
now they have changed certain rules, now they are relaxed,
now they are saying that we will remove the declaration from form 6.
What does that mean?
This clearly says that election commission,
with the help of the central government,
was actually trying to manipulate the voter list.
And once the voter list was manipulated,
we have seen the results which came out.
Take the classic example of West Bengal.
91 lakh people were disqualified from voting.
Out of those 91 lakhs, 28 lakhs people approached the tribunal.
And out of those 28 lakhs,
the hearing for 1,13,000 people was conducted
and 93% people were found eligible to vote.
So where is the democracy left if 93% people out of 1 lakh people
are found eligible and
were not allowed to vote at that particular time.
Look at the audacity. If a
Supreme Court judge says
what happened if they are not able to vote
this time, they will
vote the next time. Is this
fair? Is this fair?
And when the accountability and responsibility
is asked, this is how the government
tries to
suppress the
protests as well as the demand.
What was the reason of denotifying
Jantar Mantar as a protest site
the other
sites which have been
mentioned as you can do
the protest over there, we all know that
there is a huge fee attached to that
do you really think a tribal coming from
Chhattisgarh would be able to
pay that fee to protest over there
so basically is this defiance
Avni ji because here we also saw
that Rahul Gandhi has been spearheading
though he has been dismissing that there are no
parallel protests but he has
also extended his support to
what happened with the CJP leaders and their representatives.
However, he has not directly
named them, but has extended support.
So what does it mean? The point is very simple. As per
the Supreme Court, back in the year 2018,
Mazdoor Kisan Shakti Sangatan versus Union of India,
right to peacefully protest is a fundamental right.
Now, the question is, is there a reasonable
classification, Article 14 argument,
as to why the Delhi Police denotified Jantar Mantar,
I mean, I want to point out a very important thing. World over,
in all the major national capitals of all the major democracies,
the peaceful protest site is always close to the parliament.
And it cannot come with conditions attached.
Namely, you have to pay some money to protest there.
Or we will give you a protest site which is 25 kilometers away
from the main center of the national capital.
or that we will give you a two-hour slot permission.
You can only sit for two hours.
You cannot sit otherwise.
It's a fundamental right to peacefully protest.
And therefore, all these conditions that the Delhi police is inserting
by way of several standing orders are, first of all, unconstitutional.
Second of all, against all democratic principles.
And third of all, affirming to the common people of this country
that Delhi police is being used as a shield because now,
prime of SI, after the Indian
Express report and videos out there, prime of SI,
there is enough evidence to know that
SIR was a faulty process, that a lot of illegality took place
in the proceedings before the Election
Commission of India.
The only aim of Delhi police, as far as I can see, is they don't
want people to aggregate and sit indefinitely at one place.
And since Jantar Mantar is that
central place, which has been used since independent India,
they come up with an order and say
denotify. Where are the people supposed to go?
Where are the people supposed to go? It's
not a question of CJP, Congress, Neha Bora.
It's not a question of who's doing. Every
common person, whoever they are,
have a right to peacefully protest. Amita, there was a
time in Jantar Mantar, whenever you go,
there would be a group of people sitting and lodging
their protest. Is this government taking away that right?
And on what basis? What? The Delhi
police comes up and says overnight
that Jantar Mantar denotified. We should all clap and
say, oh, now I can't go to Jantar Mantar.
Who gives the Delhi police that right? And
where are people supposed to go?
Saying go to Ramlila Maidan, where either you need like
a big crowd or you need to pay money.
Say go to CBD Maidan, go to Burari Maidan. These
spaces are far away what is the whole point
of peaceful protest the whole point is every person
has a right to register dissent it is part of your freedom of speech
and expression so let me
take my first so Amita, Amita my first point
is this entire overnight we are denotifying Jantar
Mantar is grave injustice is absolutely unconstitutional
and we will not take it
lying down as citizens let me take opening comments
from all of our panelists because
Ashutosh ji in a way, legally, if you can keep it forward.
The main premise of the opposition
and their protest has been that there has been,
you know, modifications to form six,
the entire case, which is already sub-judice.
The Delhi SIR will also come up on the 28th
of October. The Supreme Court is very well aware
of what has been happening. But despite
when it comes to Jantar Mantar being denotified,
the Delhi police also did a briefing as to
why they are not granting permission
because they have been saying that what the promises were made
they were violated so there has been a breach
and in fact when it comes to this one year peace bond
as well well it has been breached within one week
so what are we now looking at legally only when it
comes to those who are violating the law
is it only applicable on them what about those who have
to enforce the law yes uh see uh first
of all let's talk about the three judgments which are
very very important and crucial passed
by the supreme court the first one was the Himmatlal
Shah judgment that came in 1973 then as my friend
also mentioned a judgment which was passed
against i mean that was in 2018
and then again one judgment was passed in 2020 that was
another judgment in which the Supreme Court in Shaheen Bagh
also confirmed that, yes,
there is no doubt that, you know,
the peaceful protest without arms is absolutely, you know,
is a fundamental right of a citizen.
And it confirmed that.
However, the Supreme Court also has given certain powers
and authorities to the law
enforcement agencies like police to conduct a proper,
you know, protest and they can decide
the time and place and manner of assembly that is there
in the same judgments so from that judgment
if you see certain powers
and authorities have been given to the to the police or to the law
enforcement agencies now if somebody says
that they have exceeded into onto their powers or
whatsoever that again has to be by the court
because we know that one contempt petition was
filed after the 9th October
order of the Supreme Court that it
was not complied. In the Supreme Court
obviously it has already
No, but when it comes to denotification of Jantar
Mantar Mr. Ashutosh ji, I'm just coming to you
Avni ji and Rajiv ji. I have two more panelists for their
opening statements. When we speak of
Jantar Mantar being denotified overnight
now what were the compulsions that we
are now looking at?
The Delhi police saying that certain area was
permitted, certain time was permitted
the people who were protesting were
in violation and also calling
for a march what happened in july
to parliament well parliament is a highly sensitive and very
protective zone and it cannot be turned into a place of protest
so are there any breaches you
know as far as what the delhi police have
been saying in their argument ashutosh ji what does
the law say in this case now see
the other one what you asked about uh form six so i would like
to say that in electoral rules 1961 there
are certain powers being given to the election
commission and also if you see article uh 324
which gives certain powers to the election
commissioner to to make uh you know the rules
or regulations so far as you know conducting a fair
and uh impartial election is concerned has been entrusted upon it
but you know obviously i
completely understand that it has to be obviously verified
and examined by the Supreme Court in this
regard whether the election commissioner really,
you know, conducted a proper, you know, used
its power properly or not,
whether it has exceeded its powers, or whether it was, you
know, having such powers to do so.
So I think these issues are already sub judice before
the Supreme Court to decide.
Otherwise, the thing would have been already clarified.
Because all of these things are under the purview
of the Supreme Court, Anuja ji. What's
the point of the protest because it is the very same Supreme Court
when the Congress Party and
its social media handle had
also faced a lot of flak for raising a statement against the CJI.
However, that has been taken back
and to which Rahul Gandhi also gave a statement saying,
but we are political persons,
so politically they will continue to raise the protest.
You're asking to a BJP spokesperson, right, these questions?
Yes, but I'm just asking what's the point of the protest
when it comes to the matter which
is already under the consideration of the Supreme Court
so i am when when when when bjp is protesting
no i'm sorry i i are you sure what questions
are you asking yes anuja ji i am asking you
that when it comes to the bjp
which has been holding multiple press briefings which has been
denouncing the opposition protest questioning that why exactly
or what exactly is the intention of
the opposition protest when the matter is already in the Supreme Court
so you have this bjp which
has been leading its protest you have the congress party
which has been leading its protest i hope i'm
clear ma'am now now yeah now i'm clear i i got
to know i don't know why you were asking this question
so what we see forward is that if anyone
who has been doing a protest after the site is
denotification and with the denotified it becomes
in the purview of the law that anybody jumping the
barricade and these three people
who are right now behind the barricade they jumped the barricade
they're trying to again create a peace
and a harmony which is going to be disrupted
after they filled a bond after they build a bond of 50 000
and that is a court contempt
october 9 supreme court we all know that has said
that please give a suitable alternative
sites. And it is being kept saying
because the people of India or the people of Delhi
are under the preview of the lot of pressure
on them that they are not able to take train,
they're not able to go anywhere.
The situation is like a deadlock. And they also said that
they need to be identified and designated.
So what the police did, they have given the
three sites to these protesters that you can go ahead and do it.
Now, if you jump the barricade
and trying to become Bajrang Bali Hanuman somewhere
and you show that we can do this
and we do not care
and that is what they said.
No, but is displaying a tiranga,
does it amount to a crime, Anuja ji?
This is not a place to display
any kind of a tiranga or not.
Jantar Mantar was being a designated site
for the protest.
Secondly, I would also like it
to compare them with the times
when my friend from Congress said,
Oh my God, it is unconstitutional.
It is a clap, clap, clap.
Please give me this brief on Rajiv Gandhi's 1988 protest time
When the Kisan Farmers, Bhartiya Kisan Union was there
And 5 lakh people were protesting
9,507 farmers were put behind bars
And now they talk about police who are being selfish
They talk about police who are being unauthorized
I am asking them during Rajiv Gandhi time
You have used tear gas
you have used lathi charge on those people
on 1990 Jantar Mantar was been asked to be as a
protest site but right now where the five people
were there at the Boat Club it got denotified at
the very minute without being given any further notification coming
to you Rajiv ji so giving
so giving us a gyan sitting out here please look
into your own Rajiv Gandhi's time and a Congress
and go clap clap clap in an unconstitutional let me take
a quick counter from Abhi before I go
across to Harish ji coming to you Harish ji thank you
for your patience yes Abhi quick counter
uh Amita ji the way BJP is using
the law it reminds one of the times of the Britishers
in India what we have as per the constitution
is rule of law what that means is anything which a
law says also has to be reasonable merely
because the law says something arbitrary does not stand
the constitutional scrutiny now Shyamji
a specific question I want to answer that
first of all let me just take you through
a brief history 1972 Himmatlal Keshav versus Commissioner
of police no prior permission required
to peacefully protest from the commissioner
Ramlila Maidan incident uh this was a case before
that Anita Thakur versus State of Jammu and Kashmir
2016 holding peaceful demonstrations in order
to air grievances is a peaceful right in Varun
state versus police commissioner
the National Green Tribunal said that Jantar Mantar cannot
be a protest site this history is very important Amitaji
this was overruled in the supreme by the
supreme court in the case of MKSS in the year 2018 even after
that in Amitani that is a Shaheen
bar case versus state 2020 again it was held
that the right to peaceful protest is a fundamental
right so the point is just
because you are using the delhi police to come up with any sort of an
order that does not give you a blanket protection under
the constitution the question that is being
asked is the delhi police is making one argument right
that the last time we gave the place to
protest you sat for many days
but the question is how is this reasonable that the delhi police
will decide for how many days can i sit
and peacefully protest it is a designated site right
no but where would you go seek for permission
no no no first of all amita ji yeah
that's a very important question you're absolutely
right please understand the constitutional scheme
if it is a designated my right to protest peacefully
is a fundamental right correct it
extends everywhere now if it
is a designated protest site it does not require permission
if i am then your party
or some groups are not the only ones in the entire country are holding
protests no ma'am there would be other there would
be other organizations as well who would
want to hold protests so if you are occupying the entire Jantar Mantar
then where will others go
please understand the question is then
the police should have made guidelines accordingly why has
the police completely denotified
Jantar Mantar.
Because many people will protest.
Because many people will protest.
You will denotify Jantar Mantar itself.
The question is, how can the Delhi police
say... No, but was there any breach
or was there any violation or not?
Because you, at the end of the day,
will blame the Delhi police.
My argument is,
that Delhi police
is constantly coming up
with these notifications,
inserting absolutely arbitrary
conditions, only for two hours.
Why is the Delhi police saying
only two hours? Where is this two-hour permission
coming from? What the Supreme Court has
said, madam, what the Supreme Court has said
is balance the rights.
But balancing does not mean exhaustion of
my rights.
It surprises me that everything that, you know, it's a matter
of political parties and because the Supreme
Court has now turned into a political
battleground in the way and the manner in which
that we are looking, even as the protest
that has now reached the Supreme Court.
in the matter, I'm told that
Rahul Gandhi's plea that has also been taken up.
But Harish, what is interesting here
is the kind of support and very carefully
planned support is now being lended.
DMK, I believe, is also now
thinking that there should be a third front
Aam Aadmi Party plus the
CJP minus the Congress.
I mean, is this a possibility
in the near future because MK Stalin
has extended his support to the CJP?
Of course. It is not
on the aspiration with
what is going to come with 2029 election
is what Mr. MK Stalin is thinking about as far as now.
But whenever there is a threat to democracy,
there is always Mr. MK Stalin's voice which comes
forefront. And number one, the beauty of our democracy is the dissent,
and dissent is always
the basic practice of any functioning democracy.
But what has happened here is Mr. Amit Shah's
Delhi Police have made sure the last protest which made sure
Dharmendra Pradhan to go down and put them into the 100% jittery spot.
So they don't want
this kind of protest to happen anywhere across India rule
and get simply till 2029. So until
then they're asking the people shouldn't open
their mouth what kind of mockery is this to our
Indian constitution. Number two,
if they want these
peaceful protests to
happen for their
scrutiny, there are prima facie
evidence for which the election
commission have gone hand in
glove with the BJP. If the BJP
conscience is much more clear
and if they are truthful to the constitutional
vote they have taken, and the
ECI is an autonomous body, what
made them to go ahead and safeguard the
ECI? And Mr. Gyanesh Kumar,
if there is any impropriety
Go ahead.
So there is going to be an India block opposition
in Chennai tomorrow, sir.
So do you believe that the DMK should also extend support?
Because then question will become very selective.
Because if the TVK wins the two by-poll seats,
then somehow there is no vote chori over here.
You don't need an India block for the DMK to go ahead
and lend their support for the CJP's protest
or for any kind of protest which is attacking the Indian democracy.
So you don't need an India block.
When Mr. M.K. Stalin is very much clear that the India bloc,
without Congress, they are well accepted.
Because what they, the Congress, what they did
in Tamil Nadu will never go well in the history of Tamil culture.
It is a backstabbing to the left, right and center.
So having said that, when, according to this CJP protest,
which is functionally, which is the constitutional rights provided
to all the citizens of this country.
So if you want to strangle, if you want to go ahead
and make sure the CJPs doesn't grow as a third party,
then the vote in the level playing field,
we have to keep both the Congress and the BJP.
It was not a political party, sir.
It's an organization which has been raising its voice.
Of course there is an aspiration. Of course there will
be a political party which might form during the 2024 elections.
But having said that, leave aside everything.
You have the fundamental rights given to each
and every citizen, whether you like it or not.
Why you have to strangle Mr. Amit Shah and Mr. Modi?
Why they have to get the fear the youth of this country is watching?
Why you have to strangle such a downtrodden kind of culture
you bring among the youth of this country?
You're beating the girls who are just 12 years, 13 years kids.
Who gave you those kind of power, excessive power?
So youth of this country should go ahead and make sure
to protest wherever they want when they have the dissent for this.
Anujaji, a quick counter. I'll just come to you, Rajivji, because
this has been highlighted by Union Minister Piyush Goyalji yesterday
and by the Home Minister himself, because they are of the opinion that
the collective narrative of the opposition has no takers on ground.
The reality is very different from the narrative what
the opposition is trying to set, Anujaji.
that is that that is what it is happening they they they
do not walk the talk and what is
happening is they just try to show everybody
and fool around that they are together but during
their own areas of expertise in their own states they are the ones
who are killing each other
believe me you these people are the biggest snakes sitting
in the opposition who do not want
the growth of India, who do not want the growth of the nation.
They just want to keep stabbing
the Indian people. And they talk about the voters.
I am sorry, once again, the Gujarat
Vipers, again, how come the BJP wins?
It is the mindset. It is, yes, it is the mindset of the
people which they cannot hijack.
The hijack has happened because we have worked on the ground.
we still work on the ground
and I thank everybody in the opposition for making us
again the prime minister of India we keep on working
and I and they are they are the
they are our spokespersons
so let me take that counter to Rajiv ji Rajiv ji then vote
chori sir kitne levels pe ho sakte hai sir
the the municipal elections the university election
results why is that not a reflection
of the vote chori narrative that is now being built
why is that and if the election results do not come in your favor
then it you know automatically
you will come to a conclusion that there has
been vote chori rajiv before i answer that question
i just pity at the bjp spokesperson whatever
justification she gave whatever happened at
jantar mantar she said that this is what happened
in the congress regime they're just trying to
justify this what happened earlier two wrongs
will never make one correct okay the second thing
She said that this was not a designated place to display the Tiranga.
Now, this is where they have brought this country to.
Is there any designated place required to display the Tiranga?
Do we actually need it?
This is the next step this government would try to control us with.
Now, coming back to your question.
So, if there are credible questions raised
by the election commissioner itself,
two of the election uh commissioner out
of the three uh members of election commission if they
have raised certain doubts someone needs to answer them
this is not a party versus party fight this
is the people of india asking these questions now it
was said that there was no credibility to the
agitation which was called there was no uh people support
to this movement if there was no people
support to this movement why
was 257 trains cancelled why 55 of the metro stations were
not operational on that particular day what
this was the biggest fear of this government if they
would have allowed this protest peaceful protest
to happen the they would have been exposed people
in lakhs of numbers were supposed to come on that particular day
and despite all the bans and all
the suppression, they could not
stop the people from coming there.
We have seen thousands and thousands of people...
And sir, what if any untoward activity would have happened?
Who would have taken responsibility?
So, just... This is the
responsibility of the Home Minister to ensure
that whenever someone calls
for a peaceful protest, he needs
to ensure that police measures up
the things so that no peaceful
unlawful activity happens over there.
Just by saying that some unlawful
activity would happen, you
cannot deny me my right of
a peaceful protest, you have to go to Avni
as well yes, have you seen the hypocrisy? So Amit Shah ji will
take care of the violence which is going to happen
which will be done by the protesters
why will Amit Shah ji will take care at that time, why will we not protest
when we will feel that
it has not been taken under the proper guideline
when it has not been taken under the rules and
regulation, why MHA will do it later? It will do at the very minute
and that is what we have done
and that is what we have keep doing it, look
at 26 July, Amita, do you see what has happened? Do
they call, do you call as an anchor that it
was a peaceful protest? Do you tell me in 2021 was a
farmer protest was a peaceful protest, please tell me the borders
and obviously do you think what is
the definition of a peaceful protest.
In 2020, anti-CAA unrest, Delhi riots. Tell me, was
it a peaceful protest? 2018, SCSC.
I think we can go back because when it comes to the
protests and the number of them that you've
been highlighting, but Avni ji, where is the
proof? Where is the evidence?
This is something which Rahul Gandhi has been talking about
saying, and there is a lot of saboot to it
But where is the evidence of vote chori or
the narrative that is being said?
Because similar thing that he said also while submitting
his memorandum to the president the president asked him
in return do you have the required
evidence to prove that there has
been vote chori, yeah Amita ji, for anybody looking for proof I
highly recommend that they go to Indian Express, read the entire report
also look at the video
there are several reports that have
been put out there as to how only a small select team
sitting in the sitting in Delhi in the IT cell
of the ECI has blocked the access of the EROs
who are the election officers on ground.
Now, one second, Amitaji.
The basic premise of your argument again,
why I'm saying that because this is already under
the purview of the Supreme Court,
what did the Supreme Court say, ma'am?
The matter when it was being heard,
when it comes to the newspaper report,
100% it may be right or may not be wrong.
So the Supreme Court is not coming under
the influence of the newspaper report.
One second.
The Supreme Court process is a long process
and what the Supreme Court eventually decides on this matter
is eventually something we will all have to wait for.
In the meantime, because there is prima facie proof already,
people have a right to peacefully protest,
to question, to express dissent and to express opinions.
BJP spokesperson saying on your TV
that Home Minister Ji, why should he take the responsibility,
in my mind is lack of basic understanding
of the Home Minister's profile, what he does in the country.
The Home Minister will, of course,
always have to ensure security for everybody whatsoever.
Now, the question is, Amita,
when the Jantar Mantar site has been denotified, what will happen?
People who want to peacefully protest will come on the streets.
If any untoward incident were to happen
on the street, what happens then?
So is taking away the designated protest site ever
a good idea by any government?
And to your point and to our spokespersons, I agree with him there,
that if people were not resonating on the ground,
then this government wouldn't fear so much.
So many trains, metros, in spite of the Supreme Court direction,
wouldn't have been closed.
And also the bigger question is that while we are seeing
these peaceful protests, a very important question,
one second, a very important question is the illegal torture
and the illegal detentions that are being made.
Some of the videos, Amita, which are coming out are horrific.
The way in which the Delhi police is beating some
of the peaceful protesters, some of whom were not even protesting.
I saw on the NSUI as well, Rahul Gandhi stood with them,
calling them a shaheed and shaheedni.
But again, that is one version. Ashutosh ji,
somebody needs to speak up on the Delhi police's side as well.
Who is going to talk about their story and their version
and the kind of action that they had to initiate and follow up?
because that is when their role becomes important,
safeguarding the citizens.
No, no, definitely when, as I said earlier also,
when these contempt proceedings have been initiated
in the Supreme Court, that was on Sunday,
so a special hearing took place
and the bench has already,
Supreme Court bench has already sent notices
to the police also, to the government also,
and asking if their, you know,
role in the entire issue was justified or not.
So, they are supposed to file their affidavit.
So, obviously, there are courts which are also looking at these issues.
It is not that the police has
been given absolute powers at the same time.
But yes, as I said that, you know, somebody said, you know,
I mean, going to a particular place is not a crime or an offense.
See, that is something for what purpose somebody is going
when a site is denotified.
So, that also has to be considered by the concerned court.
And accordingly, I think
the court will decide whether bail should be granted or not.
So, Rajivji, for concluding statement, sir,
the intention is something which is a violation.
Displaying of a Tiranga is not.
Yes, absolutely. This is what I said.
Yes. Rajdeep ji, final comments.
I just, going back to what BJP spokesperson was saying,
I'm just saying, let the truth come out.
Let the Election Commission hold a press conference
and say that whatever the Indian Express report is stating,
it is absolutely incorrect.
Till that time, it doesn't happen.
People will have their own questions.
And if you will try to suppress those questions,
people will come out in large numbers and protest.
You cannot stop people from protesting in a peaceful way.
That's a democratic right.
Okay. Anuja ji, final comment ma'am.
They are now coming out to say
that the BJP has become the spokesperson of the ECI.
why is the ECI and the commissioners themselves not coming out
and clarifying and putting an end
to the controversy? Why didn't they go to the ECI?
They went to Draupadi Murmu. Was she an ECI?
Why didn't they go with the clarification?
If they had a clarification, they could have taken
it to the Draupadi Murmu. They could have taken to anywhere,
but they are not showing it. They
show it on TV primetime, give it, show it to us like,
you know, Ahmadiyya Party used to give a
white paper. So we are just asking if you have something, then delete.
Then please ask Congress
and the other people who have become an MP
and sitting here in the parliament should
give away their seats because an SIR gave them the seats then.
So they should take away
their seats. The Congress should step down.
And Rahul Gandhi should step down from the
YNAB. Because in 2026, the SIR was there.
He should step down. And I would only like
to ask that there is a problem with these people.
They just need to start up a situation.
So, Abni, for the last five seconds,
vote-chori cannot be selective coming in from the BJP.
ma'am first of all rahul gandhi tried to go to the election commission
and was stopped I don't
think if the BJP spokesperson knows about
this or not. The second point is and this is my final
comment, Amita, on your show. Right to peaceful protest
is a fundamental right. All these standing
orders that the Delhi Police is coming up with we
are against it. We will uphold the constitutional
fundamental right to protest come what may
and I am against Jantar Mantar being denotified as a
protest site. That will have to go
and Gyanesh Kumar along with it will also have to go. Well
that remains at the end of the day. Really what happens
because this is all developing politically
as well legally as well. What will
be the conclusions? What will be the consequences
well for now we're looking at as far as two
of the CPJ leaders are concerned they have now been
sent to five-day judicial custody. Thank you very much all
of you for joining us here on the Urban
Debate. Thank you very much
