Attorney speaks after inmate 'escaped' Hays County jail

Prosecutors have dropped escape charges against 21-year-old Xavier Gutierrez after it was revealed he did not intentionally flee the Hayes County Jail, but was instead accidentally released by staff who mistook him for another inmate. Gutierrez will instead plead no contest to a misdemeanor evading arrest charge, receiving credit for time already served.
