Disability insurance attorney Gregory Dell discusses a MetLife long term disability insurance buyout of ERISA group disability policies and individual disability policies.
Hi, I'm Greg Dell and I want to talk about MetLife Long-Term Disability Lumsum Buyouts.
So, there's a likelihood that MetLife has sent you a letter asking you if you'd be interested
in selling your long-term disability policy. Now, this is a voluntary program that you're
not required to participate in and there's a couple things you need to consider when evaluating
this potential buyout offer. First of all, you got to think about what are they actually offering
you and what are the available benefits for you for the duration of your policy. Second thing you
got to think about is what's the likelihood that you're going to receive benefits for the duration
of the policy. Another thing you got to consider is, is it really worth giving up probably 30 to
40 percent of your benefits to get a lump sum of cash now. Every situation is different when it
to evaluating a lump sum buyout and the value that's placed on your lump sum buyout can differ
based upon the high yield corporate bond rate, what your potential risk factors are for your
condition. For example, some conditions may prevent a claimant from living until the maximum benefit
period, whereas someone else may have a medical condition that has no impact on their ability to
live to age 65 or whatever age the policy pays to. Now, MetLife just started offering these lump sum
disability buyouts in 2016 on the group long-term disability policies. On the individual disability
policies which are not governed by ERISA, MetLife has been offering buyouts for many years and we've
been able to negotiate excellent settlements for our clients. On the group side, it's a program they
just started again January of 2016. I'm not sure if they're going to continue to do it, but from
recent conversations and having helped many people get these MetLife group buyouts already,
MetLife seems to be happy with the way the buyouts are going and we have found that they're actually
making reasonable settlement offers on these buyouts. So if you've been offered a MetLife
buyout or you're interested in a MetLife buyout, feel free to contact us. We'll do our best to help
you negotiate the best settlement possible. We'll let you know all of the risk factors you need to
consider when accepting this offer. We'll make sure that you have a release that protects you
so in the event that you do accept this offer, you're free to do whatever you want and you never
need to worry about MetLife coming back after you for anything. When you accept a lump sum settlement,
it's a complete settlement. It's almost like a divorce where there's no further obligations
whatsoever on your part to MetLife and MetLife has no obligations to you.
We always offer a free consultation and I look forward to speaking with you.
