Artificial intelligence is increasingly being used in many areas of criminal justice entities.
Dan Omanahan spoke with a research professor and attorney about the pros and cons.
The onset of AI has offered a lot of new potential for use in various sectors of society,
including criminal justice. Attorney Maura Grossman says AI can be useful in speeding
up administrative tasks. If there are lengthy transcripts that a court might need to be
summarized, AI can be used for that. AI can be used to set up websites with chatbots where
people who are not represented by lawyers can get information about how to manage their case,
how to navigate the system. Grossman says AI can be a powerful tool
for overturning unfair prosecutions. If there are certain characteristics
that are unique to certain kinds of wrongful convictions, then you can analyze vast amounts
of data looking for cases that might have that particular characteristic or set of features.
But what about potential pitfalls like a recent case out of Washington state?
Defendant Joshua Palucco was charged with three counts of murder stemming from a 2021 shooting.
The shooting was captured on a smartphone, and the video was entered into evidence.
The defense sought to admit an AI-enhanced version of the video,
arguing that the original was low-resolution, blurred, and featured blocky edges.
Ultimately, the court did not let in the AI-enhanced videos because the court felt
this was not a tool that's been used forensically and that is accepted in the forensic community,
and the person who had enhanced the videos couldn't really explain how the tool had worked,
exactly what it did with the pixels, and it apparently changed them 16 times or something
like that. Another issue Grossman calls attention to
is deepfakes. She brings up a case involving a phony German CEO.
Somebody got a call, somebody at a company, a subsidiary got a call from what he thought was
the German CEO of the company telling him to move 200,000 sterling into a Hungarian bank account,
and he did it, and then he found out that wasn't his boss calling him at all.
AI has been applied in sentencing, but some studies have argued that racial bias can occur.
It wasn't that the tools were asking questions about race, but they were asking questions
that were correlated with race, like have you had family members who have been in jail,
how many of your friends and associates have been arrested for drug use,
things like that, which tend to be highly correlated with race.
From data crunching to overturned convictions to deepfake abuse potential,
AI presents many challenges along with potential to change lives. Daniel Monaghan, NTD News.
