Mahkamah Konstitusi menolak lima perkara permohonan perubahan batas usia minimal capres-cawapres dalam sidang yang digelar, Senin (16/10). Namun satu perkara yang diajukan mahasiswa UNS dikabulkan, sehingga MK menetapkan batas usia minimal capres-cawapres tetap 40 tahun. Sedangkan salah satu permohonan yang akhirnya dikabulkan sebagian yaitu pernah/sedang menduduki jabatan yang dipilih melalui pemilihan umum termasuk pemilihan kepala daerah meski berusia di bawah 40 tahun. The Constitutional Court held a decision on the material test, Article 169, the letter Ki,
which regulates the minimum age of Capres and Cawapres on October 16.
The decision was presented by nine constitutional judges and led by Chief Justice Anwar Usman.
The Constitutional Court rejected five cases that requested a change in the minimum age of Capres-Cawapres,
while another case was partially approved.
Thus, the Constitutional Court decided that the minimum age of Capres-Cawapres is still 40 years,
or has ever been, or is currently sitting in the elected office through a general election, including a regional election.
Here is the statement of the PSI as one of the petitioners.
If from the current MKI decision, there is a greater opportunity for young people,
there is no age limit of 35 years, it is actually too much.
But again, the main focus of some of these petitions is actually related to competition, right?
If earlier it was said that they have experience as head of the region,
so the point is the competition of these young candidates, not limited to their age.
There are seven petitions that were received by the MKI regarding the minimum age of Capres-Cawapres.
Two of the seven petitions were submitted by the political parties, namely the PSI and the Garuda Party.
One of them was submitted by the representatives of the regional leaders,
and the remaining four petitions were submitted individually.
These seven petitions asked the Constitutional Court to change the minimum age of Capres and Cawapres.
There are reports asking to change it to 35 years, 21 years, 25 years, 30 years, up to 40 years.
However, by including the conditions of experience as a state legislator.
Of the seven petitions, one of them was withdrawn, five were rejected, and one case was partially accepted.
By setting the age limit of Capres-Cawapres as 40 years or has ever served as head of the region,
the Constitutional Court gave a green light for Capres-Cawapres under the age of 40 years,
but experienced as head of a region to contest the 2024 election.
