One of the things that many clients get wrong in their agreements with contractors is that they fail to get TIME LIMITS stipulated in their contracts.

In some instance, they don't have written construction contracts at all!

These documents--construction contracts--are designed to protect both parties involved (client/contractor), and ensure that both parties understand the agreed-upon conditions.

In most contracts, TERM is the word used to denote the start date and end date of the full contract. This is a very important part of the contract!

Max and Justin tend to set long TERMS for their construction contracts--this does not necessarily mean that a project will actually take that long. It only means that, according to the conditions of the contract, the project MUST be finished by that end date.

This leaves ample room for the many challenges that will arise throughout the course of a construction project. It also preserves the contract, because if a single clause, such as the term, is broken, then the entire contract may be moot, and both parties unprotected by the document.

CHANGE ORDERS are changes to the original plan, requested by the client. Change Orders do not necessarily apply to the TERM of the original contract.

Furthermore, Max and Justin use a document known as a SCHEDULE OF VALUES to keep their projects on schedule, and their clients informed.

A SCHEDULE OF VALUES is a running list of all the phases of a job. It notes what those phases cost, what their level of completion may be, and even what percentage is left to be paid by the client.

Modern Mountain Builders keep their Schedule Of Values in a GOOGLE DOC that the client has access to. This way, the client can see the full progress of the job at any time, and even understand when pay-outs should occur.

Not every contractor will use a schedule of values...but the ones who do are going above and beyond for their clients. This sets a very high level of honesty and transparency.
