The U.S. Department of Justice has issued a new indictment against former FBI Director James Comey, alleging his involvement in a matter tied to a social media image that officials said was interpreted as a threat toward Donald Trump, according to a report by CNN.
The case centers on a photograph Comey posted last May showing seashells arranged to display the numbers “86 47.” The post included the caption, “Cool shell formation on my beach walk.” Critics, including Republican lawmakers and administration officials, argued the numbers could be interpreted as a call to harm the president, with “86” sometimes used as slang meaning to remove or eliminate, and “47” corresponding to Trump’s position as the 47th president.
Following the post, Comey deleted the image and addressed the reaction publicly, stating, “It never occurred to me but I oppose violence of any kind so I took the post down.” He also said he initially believed the shells reflected a political message but “didn’t realize some folks associate those numbers with violence.”
The U.S. Secret Service conducted an extended interview with Comey in Washington after the post surfaced, an uncommon step in response to a non-specific or indirect statement. Comey told investigators he encountered the shell arrangement while walking along a beach in North Carolina.
Officials within the administration responded strongly at the time. Tulsi Gabbard said in a televised interview that Comey should be “put behind bars for this” and expressed concern about potential risks to the president.
The new indictment represents the second attempt by federal prosecutors to pursue charges against Comey. In a prior case filed in September, the Justice Department accused him of making false statements to Congress related to disclosures to the press. That case was dismissed by a federal judge, who ruled that the acting U.S. attorney overseeing the prosecution had not been properly appointed.
Legal analysts cited in a separate CNN report have indicated that pursuing charges tied to the social media post could face challenges, particularly in light of constitutional protections related to speech.
The renewed legal action comes as tensions between Comey and Trump remain longstanding. Comey, who led the FBI during early investigations into alleged ties between Trump’s 2016 campaign and Russia, was dismissed from his position in 2017. Since then, he has been a frequent critic of the president.
Comey’s legal representatives declined to comment on the latest indictment. Federal officials have not released additional details regarding the timeline for court proceedings.
