Following the post, Comey deleted the image and addressed the reaction publicly, stating, “It never occurred to me but I oppose violence of any kind so I took the post down.” He also said he initially believed the shells reflected a political message but “didn’t realize some folks associate those numbers with violence.”

The U.S. Secret Service conducted an extended interview with Comey in Washington after the post surfaced, an uncommon step in response to a non-specific or indirect statement. Comey told investigators he encountered the shell arrangement while walking along a beach in North Carolina.

Officials within the administration responded strongly at the time. Tulsi Gabbard said in a televised interview that Comey should be “put behind bars for this” and expressed concern about potential risks to the president.

The new indictment represents the second attempt by federal prosecutors to pursue charges against Comey. In a prior case filed in September, the Justice Department accused him of making false statements to Congress related to disclosures to the press. That case was dismissed by a federal judge, who ruled that the acting U.S. attorney overseeing the prosecution had not been properly appointed.

Legal analysts cited in a separate CNN report have indicated that pursuing charges tied to the social media post could face challenges, particularly in light of constitutional protections related to speech.

The renewed legal action comes as tensions between Comey and Trump remain longstanding.
