A retrial in the rape case against former film producer Harvey Weinstein is scheduled to begin Tuesday in a Manhattan courtroom, following a mistrial declared last year when jurors were unable to reach a unanimous decision.
Weinstein faces a charge of third-degree rape involving Jessica Mann, an actress who appeared in the 2015 film “This Isn’t Funny.” The case returns to court after a jury in June was deadlocked, prompting the judge to end deliberations amid reported internal conflict among jurors.
Despite the outcome of the retrial, Weinstein will remain incarcerated due to a separate conviction in California, where he is serving a 16-year sentence for the rape of a European actress. An appeal hearing in that case is scheduled for April 23.
Weinstein’s spokesperson, Juda Engelmayer, said the former producer is optimistic about the upcoming proceedings. “He is hopeful and expects a fair process where the facts will vindicate him,” Engelmayer told AFP.
The 74-year-old, who has been in declining health and uses a wheelchair, has faced multiple legal battles since allegations against him surfaced in 2017, leading to widespread scrutiny within the entertainment industry and beyond.
In the prior New York proceedings, the jury convicted Weinstein of sexual assault involving film producer Miriam Haley. That conviction is currently under appeal. He was acquitted of a separate sexual assault allegation involving actress Kaja Sokola.
Haley had also been a key witness in Weinstein’s earlier 2020 conviction, which resulted in a 23-year prison sentence. That conviction was overturned in 2024 after an appellate court identified issues related to how testimony from certain witnesses was presented.
Weinstein has assembled a new legal team for the retrial, including attorneys Jacob Kaplan and Marc Agnifilo, who has represented several high-profile clients.
He is currently being held at the Rikers Island jail complex in New York City. In prior remarks to the Hollywood Reporter, Weinstein described conditions at the facility as unsafe, stating, “I’m constantly threatened and derided. I wouldn’t last long out there.”
He also alleged that he had been physically assaulted while in custody. “I fell on the floor, bleeding everywhere. I was hurt really badly,” he said, describing an incident in which he claimed to have been struck while waiting to use a phone.
The retrial will revisit evidence and testimony related to the Mann allegation as prosecutors seek to secure a conviction on the unresolved charge.
