A federal appeals court on Friday vacated a preliminary injunction that had blocked President Donald Trump’s executive orders aimed at ending diversity, equity, and inclusion programs across the executive branch and among recipients of federal funding, clearing the way for the directives to move forward as litigation continues.
Trump issued two executive orders early in his second term directing federal agencies to eliminate DEI policies within government operations and to apply similar standards to entities receiving federal grants. In the text of one order, Trump stated that, “The Biden Administration forced illegal and immoral discrimination programs, going by the name ‘diversity, equity, and inclusion’ (DEI), into virtually all aspects of the Federal Government, in areas ranging from airline safety to the military.” He added that the effort began “from President Biden’s first day in office, when he issued Executive Order 13985, ‘Advancing Racial Equity and Support for Underserved Communities Through the Federal Government.’”
The mayor and City Council of Baltimore, Maryland, along with three national associations, challenged the orders in court. A Biden-appointed U.S. district judge entered a preliminary injunction last year blocking enforcement of the directives, as reflected in the district court’s order available in the case record here.
In an earlier procedural ruling, a three-judge panel of the U.S. Court of Appeals for the Fourth Circuit—Chief Judge Albert Diaz, Judge Pamela Harris, and Judge Allison Blair Jones Rushing—granted the government’s request to stay that injunction while the appeal was pending. That stay did not resolve the merits of the case.
On Friday, the same appellate panel issued a decision vacating the injunction and remanding the matter to the district court. In their opinion, the judges wrote, “In the first days of his second term, President Donald J. Trump issued two Executive Orders that directed executive agencies to end ‘diversity, equity, and inclusion’ (‘DEI’) programs within federal grant and contract processes.” The court continued, “The district court entered a preliminary injunction, but we stayed it pending appeal. We now vacate the district court’s injunction and remand,” according to the appellate ruling issued by the court.
The decision restores the administration’s authority to implement the executive orders while the underlying legal challenges proceed.
