President calls 2022 FBI search an “unreasonable seizure” after declassified emails reveal DOJ ignored FBI warnings about lack of probable cause.

President Donald Trump escalated his criticism of the 2022 FBI raid on Mar-a-Lago late Tuesday, calling it an “unreasonable search and seizure“ and endorsing calls for the arrest of former FBI Director Christopher Wray, former Attorney General Merrick Garland, and others involved in the operation.

“Unreasonable Search and Seizure!!! That was the FBI’s CRIMINAL RAID on Mar-a-Lago. This can never be allowed to happen again!!!” Trump posted on Truth Social. When a supporter suggested “Someone should be arrested. Wray & Garland,” Trump responded, “and many others!!!”

Declassified Emails Reveal FBI’s Internal Opposition

The president’s remarks follow Senate Judiciary Committee Chairman Chuck Grassley (R-IA) releasing declassified emails showing FBI agents warned that probable cause for the search warrant was lacking—but were overruled by Biden’s Justice Department.

“Received shocking new docs today from DOJ & FBI showing FBI DID NOT BELIEVE IT HAD PROBABLE CAUSE to raid Pres Trump’s Mar-a-Lago home but Biden DOJ pushed for it anyway,” Grassley wrote on X. “Based on the records, Mar-a-Lago raid was a miscarriage of justice.”

FBI’s Washington Field Office Raised Red Flags

Internal communications from June to August 2022 reveal that the FBI’s Washington Field Office (WFO) explicitly stated:

“WFO does not believe that we have established probable cause for the search warrant for classified records at Mar-a-Lago.”

Despite this, DOJ prosecutors insisted they had probable cause and pushed for a broad warrant covering Trump’s residence, office, and storage areas.

One FBI document called the six-week focus on probable cause “counterproductive” and noted that no witnesses had reported seeing classified records at Mar-a-Lago since Trump’s team voluntarily returned documents on June 3, 2022. The FBI recommended “less intrusive and quicker options“—but the DOJ rejected them.

FBI Director Patel Confirms Misconduct

FBI Director Kash Patel confirmed the findings, stating:

“It’s true—we just turned over documents to Capitol Hill showing the FBI told DOJ they did not have probable cause for raiding President Trump’s home, but DOJ ‘didn’t give a damn’ and did it anyway.”

The 2022 raid led to 40 federal charges against Trump for alleged mishandling of classified documents, but a federal judge dismissed the indictment in July 2024, ruling that special counsel Jack Smith’s appointment was improper. After Trump’s re-election, the Biden DOJ dropped its appeal, citing the policy against prosecuting sitting presidents.

Trump’s latest comments intensify pressure for accountability, with allies demanding investigations into the DOJ and FBI’s actions. Critics argue the raid was politically motivated, while supporters call for legal consequences for those involved.

“The American people deserve answers,” a White House official said. “This wasn’t about justice—it was about targeting a political opponent.”
