The ongoing legal battle between SpaceX and the California Coastal Commission over rocket launches at Vandenberg Space Force Base is taking a new turn, with recent developments giving SpaceX a bit of an edge.
Back in October 2024, SpaceX filed a lawsuit against the CCC, arguing that the commission was overreaching its authority by requiring a coastal development permit for its launches. SpaceX contends that most of its launch activities, especially those tied to national security, are federally governed and should be exempt from state-level permitting. The lawsuit stems from the US Air Force’s decision to allow SpaceX to launch up to 50 rockets annually from Vandenberg Air Force Base in Santa Barbara County. SpaceX also claims the commission’s actions may be politically motivated, pointing to alleged bias against Elon Musk due to his political beliefs.
In March 2025, a federal judge initially dismissed the lawsuit, citing that SpaceX hadn’t shown it had been harmed. The judge noted that despite the CCC’s objections, the US Air Force, which ultimately controls the base, continued approving launches, effectively bypassing the CCC’s authority. From the court’s perspective, since the launches weren’t actually being blocked, SpaceX couldn’t claim it was being tangibly harmed.
However, the judge did give SpaceX another shot, allowing the company to revise its complaint with more specific evidence of harm or to better explain its legal position.
