Senate Passes Short-Term FISA Extension, Delays Decision on Surveillance Reforms

Lawmakers approve 45-day continuation of Section 702 authority as debate over privacy protections remains unresolved.

The Senate on Thursday approved a temporary extension of federal surveillance authorities under Section 702 of the Foreign Intelligence Surveillance Act, advancing a 45-day measure that returns the issue to the House for further consideration.

The short-term extension ensures that the surveillance program will remain in effect while lawmakers continue negotiations over potential reforms. The House previously passed its own version of an extension that included changes aimed at increasing oversight and limiting potential misuse.

Section 702 permits U.S. intelligence agencies to conduct surveillance targeting non-U.S. individuals located abroad without a warrant. However, the authority has drawn criticism from privacy advocates and some lawmakers due to the incidental collection of communications involving American citizens.

Senate Majority Leader John Thune indicated that the temporary extension is intended to provide additional time for lawmakers to reach consensus on possible changes to the program. “[A]t this point, we’ll be able to proceed and allow for additional time and consideration so that we can come to an agreement that hopefully in this body and the House can agree upon to reauthorize the FISA program, and I think there’s a discussion going on about reforms to that,” Thune said, according to The Hill.

The decision follows ongoing debate in Congress over whether to impose stricter safeguards, including requirements for warrants before accessing data involving U.S. citizens. Lawmakers have cited past incidents of misuse as justification for reform efforts.

President Donald Trump has urged Congress to pass an extension without additional restrictions, describing the surveillance authority as essential to national security, particularly in the context of the ongoing Iran conflict. In an April post on Truth Social, Trump called for Republican lawmakers to support a “clean extension” of the program and emphasized the need for party unity during the legislative process.

“I am working very hard with our Great Speaker, Mike Johnson, along with Chairman Jim Jordan and Chairman Rick Crawford, to get a clean extension of FISA 702 through the House of Representatives this week,” Trump wrote. “I am asking Republicans to UNIFY, and vote together on the test vote to bring a clean Bill to the floor.”

The extension sets up further negotiations between the House and Senate as lawmakers weigh competing priorities of national security and civil liberties. Without a longer-term agreement, Congress will need to revisit the issue before the temporary authorization expires.
